As the comments today are stating, it’s really frustrating trying to get news about the inquest of the death of Daniel Smith. The sparse reports seem to bring more questions than answers, as “Groovy” wrote in the previous thread. I don’t see much of anything except for its been postponed until January 28th, 2008. Again.
Today the Associated Press reported that the court has expressed a wish to speak to Larry Birkhead when court reconvenes. They also want to hear from the toxologists that examined Daniel’s remains. And surprise, they want to speak to California doctor Sandeep Kapoor, who prescribed methadone to Anna Nicole Smith.
26 witnesses have testified! Wonder what they said?
The Bald Truth is reporting that when Daniel was hospitalized in California, it was because of the “misuse of valium”. They then go on to state that when Daniel answered questions for hospital records that he only mentioned his mother and not his grandmother. So my question is, did he mention HKS? Or Ray Martino whom he lived with? Who in the heck wants to do a life history after being admitted to the hospital and supposedly in serious condition? Did Daniel actually answer those questions or did Ray Martino? His mother was his immediate next of kin. Family tree not necessary. Form complete. The hospital usually is most interested in who is paying the bill.

Relinquish custody to Howard K. Stern that beheld the birth of Dannielynn…and held her for her most precious first few months of life.
That he will always care for her.
Relinquish guilt from anyone else and let them get on with their own life…
However, let everyone participate in a whole bunch of forgiveness and well wishing, and get some darn psychiatric counseling.
Larry needs a girlfriend or a wife, Virgie needs to reconcile her past and come to terms with prejudice…and how she was raised and what she learned and who she learned from.
And Howard needs Dannielynn and Dannielynn needs love, pure and simple.

I doubt Howard has much time for Dannielynn right now, she would be left with nannies, and BONNIE,god forbid.God knew what he was doing, when he let Dnnielynn be place in the arms of her bio family. and freida, you need t come to terms with that, as the others you were talking about have to come to terms, with their own problems. How do you wish a child away from her own father, WHO would have been here for her birth if it was possible.

“Medical Records exclude Arthur as family” and I think whoa– wait just one dang minute. Since when does a medical record exclude anyone as family?
I was in the ER a few weeks ago, and filled out my middle daughter’s name as a contact because we both live in the same state.
I didn’t list my oldest daughter, my oldest son, my youngest son, my grandkids, my mom, my aunts, uncles or cousins……
So…..? Would that mean that the medical records (being the powerful things they are) EXCLUDED all of them from being my family?
No, I don’t think so.
And no, I have no big issue w/ Harris. He’s okay. (His forum sucks, but that’s another story). He DOES spin though, but so do all or most entertainment reporters. He’s way better than many, but not as good as some. I just don’t worship him the way Stern’s biggest fans do.

Meanwhile, more legal trouble broke out last week for the estate of Anna Nicole Smith, which remains executed by Stern, after Yanette Luna filed a creditor’s complaint on Dec. 6 on behalf of herself and 23 other teenage weight loss wannabes, all under the age of 18.
Luna accused both TrimSpa and pill spokesperson Smith of unfair or fraudulent business acts and for promoting and supplying their product to children. The minor claims she sustained injuries as a result of the company’s behavior but does not specify their nature. However, she wants the company and estate to be held responsible for “defective or unsafe products” and is seeking an unspecified amount of punitive damages as well as restitution for her fellow failed dieters.

Blood means nothing, when you would sell your soul because of the almighty dollar. And having the same blood does not make someone a fit parent or guardian
So sad, she was so safe with Howard. Now, she is fodder for the masses and a cash cow for her all so important “biological” father.
Just being a sperm donor does not make Father. It is said, that most men can be a Father but, it takes a special Man to be a Daddy. Larry may be the Father but Howard is the Daddy. I really doubt Larry will ever be able to fill Howard’s position as the Daddy. I can see even now, that Howard has to mentor him… One other thing….I truly believe that had this baby stayed with Howard and the Stern family, that her life would have been completely different than where I think it’s headed towards. I’m sorry, but I just don’t see Howard displaying himself in front of cameras with the baby for “photo ops”. Anonymous, you are so dreaming if you think that Howard will ever – ever get custody of Dannielynn. And who knows what goes on behind closed doors with Larry and the baby? Think he is being watched to make sure the baby is being taken care of? You bet he is. If not, there would be complaints to the proper authorities.

Please see the word “plenty”. That means that Dannielynn has a large family that consists of several or more capable people that could raise Dannielynn IF need be. And yes, on Anna’s side too.

No one knows for sure what went on behind closed doors. The Haitian nannies said that Howard would not help Anna even when she fell down.
On the other hand, Mrs Gibson said that Howard and Anna had a loving relationship.
Lets talk about something that Howard himself has admitted to. What about the time that Anna was drowning and instead of Howard jumping in the pool, he yelled for Moe. How fatherly is that? Would Howard stand there and yell for someone else if Dannielynn fell in the pool?
And what is meant by “Howard and the Stern family”? Howard’s parents were not there for the birth nor did they lay eyes on the baby until after Anna died and they had to be there.
Howard signed the birth certificate only after G.Ben Thompson refused to do so. Howard knew he was not the father.
And how is Howard taking such good care of Dannielynn? Her trust fund that is known of is chump change. The properties in the Bahamas are owned by a corporation with one officer being Howards attorney. That is completely illegal in the US for an attorney to have an interest in a client property and grounds for disbarment.
I hope the site owner starts asking questions like that and someone that may have answers could enlighten the public as to why these things do not seem to be in trust for the true owner who is Dannielynn.

It is so obvious, that these types of mindless people, like you,soak up tabloid tripe and think it is really factual news. They are the proof of what severe damage the media can do against someone.
It is true anyone can be named a father but to actually be a daddy is something all together different. The law recognizes biological fathers to be caretakers. The truthful reason Anna fled and went to the Bahamas we will probably never know. What we do know is she left Larry and was denying him the paternity test. She was evading his rights as a father. Howard announced he was the father. He never announced he was the biological father and the battle of paternity started in full swing. G.Ben was also asked to put his name on the birth certificate to be father but he denied doing that. While being in the Bahamas DL had nannies who tended to her. She was cared for by the nannies while Anna and Howard took a couple of trips and tried to deal with the loss of Daniel. Once Anna passed away Howard had to deal with a lot of legal issues. DL was never outside of the house and was confined inside. Any picture of DL was always compared to Larry and Howard over paternity. The paparrazi was always lingering around to try to capture any picture of her. Larry was Annas personal photographer and wanted him to focus only on her. That was something she wanted. He had no way of knowing the value of her images or how much their worth once she passed. He took the photos at her request while she was alive. Howard was trying to preserve and repair her image and likeness after she passed to hold value which is why he did not want to state certain things on the stand while testifying in FL. Would DL be better with Howard? One can never really say. Howard must spend hours trying to deal with all the legal issues and going to court so how much time would he be able to focus on DL? I also have an opinion that if he wanted to be her father that he would have fought with everything he had not to let her go and used every possible legal manuveur to do that. But when you think of that how justifiable is that to deny DL of knowing her real father who wanted her and wanted a relationship with her..Howard did the right thing as heartbreaking as it must have been to him. In the beginning Larry was involved and for whatever reason Anna decided not to have Larry around or be involved. How different would it be if she was still alive? Eventually a paternity test would have happened and it would probably still be a nasty battle of rights. As it stands DL is loved by 2 men and their families. If you put money issues aside Howard and Larry are not fighting and working together in the best interest of DL and her well being. She has a relationship with both of them and has not been denied either one of them. They are both trying to make sure she is living the way Anna would have wanted her to. We may not like how things have happened and decisions made but if they can work together to both be involved and put differences aside then we should try to accept that the resolution they made is better than a bitter battle no matter how strongly we feel that she might be better off with one or the other.

If He tried to get money to support DannieLynn from her estate, We all know what would happen, SO he opts to support her with pictures of them both.As long as he is with her I am sure she feels secure. He could have fought Howard, on the issue of the estate, but he put his feelings aside, and opted to do what Anna wanted done. Larry is not the one who needs to apologize for anything. I try to be a little realistic, if howard and Anna thought he was the father, none of this would have taken place. I am not in love with Howard and when I say I am a Sternie it only means I support him because I feel sorry for him. I can not imagine what it would be like if after the death of my brother ppl started accusing me of murder and every thing else he had to go though. The way the media went after him was very painful for me to watch. I do like the man but do understand he has his faults. I tend to agree that it would have been easier if a DNA test was done to confirm who was the father it would have been done if they really believed that Howard was the father. A lot of heartache could have been avoided but it didn’t work that way. Maybe she didn’t know or was just in denial of it but what she did was run instead of dealing with it. We just don’t know what her reasons truly were and what motivated her to do things as she did. To go over the whys and speculate has been done and done countless times. Focusing on the inquest is really what is needed. Just for the jury to deliver the appropriate verdict is going to difficult. There are a few catergories that could be possible and the burden to prove some of these theories that are out there would be quite difficult especially with what has been presented or I should say what we know so far.

I felt sorry for Howard too and was mad at the media for the way they treated him. But many months later, while I still feel the media did him wrong, I don’t see him as the angel so many people do.
That’s what’s so weird to me in this. I read Art’s posters and Roses, and here, and some of the people who’ve been around since the very beginning seem to have just kinda gone overboard. They talk about Anna and Howards “great love” as if there weren’t a thousand other realities there, such as she did not know who the father was, tried on a couple of different men, and then just as LB started getting legal, up jumps Howard to take the reins.
That might be love in a friendship sense, but it’s not marriage love, is it?
I think people have just projected a lot of their own feelings and desires into the Anna-Howard-Larry-GB mix. I don’t think that kind of “information” is always accurate or truthful, no matter if it’s “pro” or “con”.

According to prosecutor Neil Brathwaite from the Attorney General’s office, the inquest had to be postponed this time because it was becoming increasingly difficult for witnesses to come to court.
“The remaining witnesses were not available – one of them, the toxicologist, was simply not available, so were some of the others [like] Larry Birkhead, Ford Shelly, G. Ben Thompson and Ray Martino from California and Doctor Kapoor,” he explained.
This is the third time the inquest had been adjourned in less than two months.
When the case continues, Brathwaite said he expects the witness will be available for testimony. Not on the witness list was the then coroner Magistrate Linda Virgil, who jurors heard in a testimony from a detective working the case, was present during police interviews with Anna Nicole and Howard K. Stern.
Virgil came under close scrutiny and later criticism by the Bahamian judicial system for stating that Smith’s death was “not natural.” The Bahamian Supreme Court Chief Justice later disbanded the coroner’s court shortly after her comments were published.
But, according to Brathwaite, “the decision on who will, or will not be witnesses depends on investigations conducted by the police.”

Syn, I am realistic about Howard and Anna. I understand what was going on with them and spoke previously on the board about my feelings on the way they treated Larry, it was wrong. I also know I have done things that were wrong in my life so I let it go and moved forward.
I am happy to see Larry and Howard working together and it is very clear to me Dannielynn fits with her father.
I have always been about the media and their reporting. I do not know one way or the other about Anna’s love for Howard, seems to me she had to respect him in her way of respect and her way of love.
Anna’s upbringing was a very confusing one and it reflected in her life. I think Dannielynn will do good with her dad and Anna is at peace with her son. It is a tragic tale and so much could be learned from it if you open your heart and let it.

1. Inspector Albury St. Louis, RBPF Criminal Records Officer:
Took pictures of autopsy and entered them into evidence.
Observed pinkish red abrasions in pelvic area and shoulders.
2. Marva Gibson, Immigrations Officer at the airport:
Said Daniel appeared normal, was shy and conservative and
asked for a 90 day stay. Stated arrival time as 9 p.m. ?(Is this a
difference in time zones, or did she just mis-state the time?)
3. Howard K Stern,
Testified that he identified body at morgue in the presence of
Linda Virgill (former coroner), Forsenic Pathologist Gavinda
Raju, and U. S. embassy representatives.
“Almost everytime I saw Anna, she had Danny with her”
4. Dr. Reginald Neymour, anesthesiologist
Stated he arrived at the scene 30 seconds after the code, 2
minutes before emergency team arrived. Another doctor was
there performing Chest compressions. He said the body was
cool to touch. He inserted the endo-tracial tube and an IV on
the back of Daniels left hand. He administered adrenoline
oxygen, and performed chest compressions. He remained in
the room approximately 20 minutes.
5. Dr. James Iferenta, head of ER at Doctor’s Hospital:
also stated that he arrived about 30 seconds after code and
there was another doctor working on Daniel.
Stated that Daniel’s fingers had turned blue.
He worked on Daniel for 25 minutes before stopping the code.
6. Dr. Caroline Burnett:
Pronouced Daniel dead when he arrived at Princess
Margarette Hospital when the funeral home brought him to be
tagged. Wow I hadn’t heard he went to Another
Hospital…(I thought he stayed at Doctor’s Hospital
through the autopsy.)
7. Dr. Horizal Simmons, Obstetrician:
First Doctor on the scene. Observes young male lying on the
bed and Anna standing at the foot of the bed being supported
by a male later identified as Howard Stern.
8. Nursing Assistant Francis Woodside:
Observed Daniel sleeping with Anna approximately 3 hours,
40 minutes before code sounded. The night before she
observed a “white haired gentleman” but could not identify him
by name. She visited the room 3 times during her 11:30 to
7:30 shift; once to bring pillows, once to bring Anna a
requested pain reliever, and a 6 a.m. to take Anna’s vital signs.
9. Janice Knowles, Nurse-midwife:
Did not observe anything wrong with Daniel and he was still
alive when she came to take baby to nursery at 5:30 a.m.
Stated that Daniel did not want the baby to leave.
10. Mavid Davis, phlebotomist:
Didn’t notice anything wrong with Daniel when she came to
room at 6:20 to draw blood. Observed him making
adjustments to Anna’s bed.
(Was Howard also awake at these times, was that testified to? Was he in the room each time they checked on Anna?)
11. Patrice Hanna, natal nurse, stated that the RN and the midwife were the first to respond to code. She also states that “a pill” was later found in one of the beds but wasn’t sure which bed.
12. Coralee Young, nurse on the code team:
Observed a hysterical and screaming Anna.
13. Catrione McTaggart, second nurse on code team:
Observed a hysterical and screaming Anna. Also stated that Anna attempted to continue chest compressions and Howard ventilation after the code was called off.
14. Harriett Lundy, medical technician:
Collected the urine and blood samples and sent them via
FedEx to LabCorp in Tampa, FL. (What method was used to collect the samples?)
15. Nadine Carey, RN:
sounded the code blue at 9:40. Stated when she got the the room it was already very congested. She stated that Nurse Janice Cota pulled the second bed near the door into the hall to give them more space. She noticed two pills on the top of sheet, held them until code was called off and attempted to give them to Dr. Iferenta who told her to give them to nursing supervisor, Patricia Laing. (I assume the ‘she” is Janice Cota)
16. Patricia Laing, nursing supervisor:
Testified that she gave the pills to a police officer who secured them in a plastic bag.
(Maternity is on the 2nd floor. Were the security cameras on the first and second floor, and if so, shouldn’t there be a copy of the 1st floor entries and exits? )
17. Dr. Govinda Raju, Forsenic Pathologist:
Stated Daniel died from a lethal combination of drugs injested between 4 and 6 hours before death. The only prescribed prescription in Daniel’s name was the Lexapro. The
drug combo caused his respiratory system to collapse and he went into cardiac arrest. Daniel had a LOT of abrasions and puncture wounds in his left shoulder, right upper chest, back and upper hip areas. “No sign of violence”
When asked by Munroe about the possiblility of drug buildup in the body over a period of time, Raju stated the only way to determine that would to have monitered his ability to carry out his daily activities.
Daniel had 8 drugs in his system per blood and urine samples; 5 were prescription drugs, 1 was over the counter, 2 were used in an attempt to resusitate- 5 of the drugs were depressants, 3 were stimulants.
(We need more info than this. Name all the drugs, how much of each was in his system, )
18 Carolyn Nairn, patient in room 202:
Heard a lot of commotion coming from Room 201 and a female screaming “My Baby Boy”. She is not sure of the time she heard this.
19. Dr. Charles Diggis, surgeon and medical officer:
explained standard code procedures
20. Corporal Addie Findley, police officer:
He and his partner were first officers on the scene.
21. Corporal Yvette Devereau, police officer:
First officer on the scene with partner. she found 26 tablets in Daniel’s suitcase, later identified as Lexapro. She was also given the 2 pills, and was told that they came from Daniel’s hand.
22. Frederick Taylor, Inspector, Central Detective Unit, RBPF:
stated he observed Daniel lying on the bed and Anna lying at his feet crying. Also stated that Shane Gibson, and his wife were also in the room when he arrived, but does not state what time that was.
23. Chief Superintendent Quinn McCarthy, forsenic scientist on police force:
Testified that the two pills found on the bed were a muscle relaxant and methadone. .790 mg of methadone in the blood, and 22 mg of methadone in the stomach, suggesting recent ingestion.
He stated that further study was needed to determine whether Daniel died from Drug interaction or from an overdose, when questioned by Munroe. He stated that he observe a red frothy material in the lungs, a clear sign of an overdose.
(the court also viewed digital images from the security cameras in the hallway of the hospital. It does not show that Howard left twice, and the time period of 8 a.m. until noon is missing. Where exactly are the cameras? )

Even at fifty-three I’m still the product, the offspring, the child my mother gave birth to.
Both of my parents are deceased.
They’ve been away for quite some time.
Yet, they live inside me still, and always will.

I have a 20 year old and he is and always will be a child. He is an adult, a young man but he will always be my baby, my child.
When he is married, older and has children of his own he will still be a child to me…..LOL.
Its something Parents can take the right to……LOL.
