Former FBI Bureau chief Don Clark along with Houston attorney Neil McCabe attended the inquest in the Bahamas into the death of Daniel Smith on behalf of Virgie Arthur, Daniels grandmother, who also attended.

Anna Nicole Smith’s only son died of an overdose of methadone three days after the birth of her daughter Dannielynn while Daniel was visiting them at Doctors Hospital in Nassau.

Mr. Clark explained the Bahamian court system is based upon British law. He states there are differences between their methods and the court room methods used in the United States.

He said that a Bahamian attorney was hired to guide Arthur’s attorneys through the legal “maze” and did as good of a job as anyone could hope for in determining how Daniel Smith died. When asked about a potential verdict, he said that he is skeptical as to what the ruling will be.

He said in any investigation, the scene must be secured and evidence preserved to determine a correct conclusion. However there was a void in the facts that were allowed to be presented such as the statement that was given by two nannies that cared for Dannielynn. It was not allowed into evidence. The nannies could not be located to provide their testimony.

Clark stated the huge dose of 20 to 22 tablets of methadone is what experts said killed Daniel. Also noted is that up until July of 2006, there was no evidence of any use of any kind of drugs by Daniel.

What he thought was relevant is that Daniel landed in a California hospital in July of 2006 due to anxiety and depression on the same day that Howard K. Stern left the country to join Anna Nicole in the Bahamas.

The only person that gave any testimony to the contrary was Larry Birkhead who said that Daniel and a couple of friends stole methadone from the refrigerator at the Studio City, California house. But it was argued that it’s far fetched that anything taken out of the refrigerator could be identified due to the positioning of the surveillance camera.

Mr. Clark said news reports that have been published are wrong concerning potential verdicts being taken “off the table”.

Nothing has been ruled out. The judge did not give the jury any instructions yet. So the rumor that a potential finding of homicide being taken off the table is false. He said that it was only agreed between attorneys that Daniel did not commit suicide.

Clark said hospital video of Daniel shows a young man who is happy and excited to see his mother and meet his new baby sister. He added that when a nurse came to the room to remove the baby for the night, Daniel requested the baby be allowed to stay in the room overnight.

ScaredMonkeysRadio.com said they plan to interview Mr Clark after the conclusion of the inquest.

If anyone that listened to the interview has anything to add or correct, please do. Thanks.

I missed the interview but from what I read it’s pretty horrible. I still have hope for Daniel.

Thanks QV!

QV, thanks for putting that up. I missed it because I was getting my daughter ready for bed.

:)

I see someone on Topix is saying that Don Clark is on radio because he is not credible. I have seen a couple of news shows in the past few weeks that have had Mr. Clark on as commentator. The last ones being Larry King Live and Nancy Grace. I guess that blows that theory out the window.

5 TheRestOfTheStory March 26, 2008 at 3:16 AM

QV they were just hoping that tmz’s story would fly and that no one would ever know the difference. They didn’t count on Don Clark giving an interview and setting the record straight.

6 AlamoGirl March 26, 2008 at 3:16 AM

Well, QV, they will say anything in defence of their idol. They have been tarnishing Daniel’s name for a month now, it’s time they heard the truth. But they will still insist that howie is innocent. It’s getting kind of funny actually. lol

I hope the author doesn’t mind if I post this comment of hers from Topix. (Let me know if so). She got parts that I missed…..

This is only a small part of what Don Clark said in the interview with
Scared Monkeys tonight if anyone is interested. Please overlook the
typos I was trying to listen and type at the same time.
———-
Don Clark: The reality is in terms of what happened to Daniel. It’s
going to be left up to the Bahamians. We can’t say we’ve investigated
and this is what we’ve found out.
When there is a crime scene you don’t just go in to investigate like
you believe it was an accident. You go in investigating to find out
what really happened.

There is very little interest in the Bahamas as to what someone said
at the time, or after the time.

Is there anything you can comment on the methadone

There is no question that meth is the issue. Medical experts said
Daniel died of a huge amount of methadone
There is no evidence that Daniel took methadone.
There is no evidence that Daniel Smith took medications.
July l8 2006 when hks who was visititng Las Angeles Daniel went into
the hospital for anxiety
and he was depressed. We now know that Daniel Smith was extremely
depressed when she went to the bahamas
the US was his country and he wanted his mother here in his country.
20 or 22 tablets in his body. What happened here you don’t have to be
a brain surgeon
Everyone testified he was so happy to go to the bahas to see his mom
and little sister.
A pep in his step when he walked into the hospital.

He was upset that he could not keep the baby in his lap all night.

No history of taking methadone. There was only one piece of evi. came
in by Larry Birkhead that said the cameras system saw Daniel taking
methadone out of the refrig.
and going out the door.

I have sat and looked at Videos. Sometimes you have to look at videos
several times to see

Has the media coverage slowed down? It has slowed down immensely.

It is clear that people are saying we don’t care we just want to get
it over with and get it out of here.

Talked to cab drivers, maids, etc. They will come right out and say we
know this we think the boy was killed.

WAs homicide ruled out as an option.

Don Clark that’s not true . The jury has not been instruction of
anything at this point. There was argument by the att gen office and
hks att and our att that suicide should not be considered and option.

The judge has not ruled yet as of this point as far as suicide not
being an option.

Before I walked out of the courtroom workers in Houston were calling
me and telling me that this has been decided. Not even suicide is off
the table because the judge has not given the jury instructions yet.

There is a boy that is dead and the truth needs to come out of how he
died.

If suicide could be ruled out that would be very good.

There is absolutely no evidence whatsoever that Daniel was involved in
pres type drugs or sampling any other types of drugs.

QV:

You are the best! Thank you for taking the time to post the TRUTH! I am so thankful that the jury will have the opportunity to weigh the evidence that has been presented to them, although there is a great deal of information that they were not presented!

If I was a juror in this case I would come up with an open verdict only because of the information that is lacking. But, then maybe the jury is not aware of the gaps in this story!

9 Dee March 26, 2008 at 11:34 AM

I took it that are going to do more if something isn’t done in Bahamas. I look for the FBI to start their investigation results soon after the inquest. Don Clark done a great job on the interview.

10 BamaCat March 26, 2008 at 3:26 PM

Thank you QV for posting the real truth.
That explains why the Sternies have been going bonkers.
While I still don’t hold out much hope for justice to be given in the Bahamas maybe if it is open verdict it leaves a foot in the door for CA or FL.
Homicide seems unlikely as crooked as the Bahamas are but glad to hear it has not been taken off of the table as reported.
Obviously Harvey Levin & Art Harris got their info directly from Howard Stern.

11 TheRestOfTheStory March 26, 2008 at 5:08 PM

QV thanks for sharing. :)

12 Carole March 26, 2008 at 11:24 PM

I wouldn’t worry about whether or not the Sternites think Don is credible. He was very believable to me, and has validated Harding. The Sternites have been in attack mode since the radio interview. Some of the theories they are spouting are out of Alice in Wonderland.

13 Dee March 27, 2008 at 11:40 AM

I heard Art Harris and TMZ got their news from Leons Desktop aka Bonnie Stern, Howard K. Stern or popa

14 freida1 March 27, 2008 at 1:29 PM

So, I just kinda get down off my high horse once in a while, and graze.
