It appears the Class Action suit against Lin Wood’s new law firm has “conditionally” been transferred to the Northern District Court in Texas.

There must be some type of disagreement about either the settlement, the language or both. The judge has filed an “order to show cause”.

“Plaintiff shall file a joint stipulation for dismissal or show cause why a joint stipulation has not been filed on or before November 19th, 2008. Failure to respond may result in dismissal of this case”.

The lawsuit that Anna Nicole Smith companion Howard Stern filed in U.S. District Court in West Palm Beach against famed Texas lawyer John O’Quinn has been settled.

In several TV interviews in the aftermath of Smith’s death, O’Quinn intimated that Stern murdered the Marilyn Monroe wannabe.

“Honestly, I can’t say one word about the lawsuit,” Stern told Page2Live, trying to explain why, for once, he has nothing to say. “There’s a confidentiality agreement and I can’t confirm anything.”

Court records, however, are doing some of the talking. They show reps for Stern and O’Quinn went before a mediator in Coral Gables Oct. 30 and worked it out. No details about the settlement are available.

Stern filed the slander action against the Houston barrister in April 2007, two and a half months after model and reality TV star Smith was found dead in her room at the Seminole Hard Rock in Hollywood.

O’Quinn represented Smith’s mother, Virgie Arthur, in the post-death court battle for the custody of Smith’s infant daughter, Dannielynn. Both Stern and former paparazzo Larry Birkhead claimed to be the baby daddy. DNA showed it was Birkhead.

O’Quinn accused Stern of murdering Smith on Fox News and MSNBC, telling the latter that Stern has ulterior motive for demanding to see Smith’s will days before she died.

Autopsies showed Smith died from the effects of several drugs, including methadone and antidepressants. Authorities said there was no sign of foul play.

O’Quinn, meanwhile, defended himself against Stern’s lawsuit by claiming there was no malice in his statements, and that he expressed his opinion “in the context of tabloid media.”

He didn’t return calls for comment.”

I wonder who is pouting over what? Could it be Stern? Which makes all of this more confusing because I thought both parties agreed to the “mediated settlement”. My question, which was answered on another site, is, if Howard fails to show cause, and the case is thrown out (I love it!), does that negate the confidentiality of the settlement? Inquiring minds and all that.

This situation boggles the mind. When a Settlement Agreement is reached in a Mediation, all Party’s sign a “legally binding” Agreement with all the terms set forth.
Plaintiff, his Attorney, Defendant, his Attorney , Insurance Carrier Representative and Mediator all sign before leaving the room. It is a done deal, no backing out for anyone. There are Penalities for any Breach of the Agreement. For Stern/Woods to miss the Stipulation Filing deadline will result in the Agreement being “null & void” and the entire “Suit” dismissed.

Maybe they want the suit to be thrown out. I expected that Stern wouldn’t want a case to go to trial. There would be just to much evidence brought out. I am surprised the Cosby case hasn’t been dropped. After all I cannot imagine the nannies being cross examined without someone whispering in their ears what to say.

Anna Nicole’s Haitian nannies were poor, uneducated, broken English and bribed by Shelley/ Thompson.They gave fake (unfiled) affidavit about ANS misconduct toward Shane Gibson and her baby. Rita Cosby tried to bribe those poor, wretched women.She was caught in flagranti.Of course they will not testify, people can’t lie under oath.Barth would crucify them.The same story is with Jackie Hatten, Jack Harding and other ANS “best friends”.O’Quinn was sick and tired of Anna Nicole’s scandal, that’s why he settled.The game is over.

No anon, doesn’t know what she is talking about and apparently didn’t listen to the Tape Recordings that Bains produced. If she did she would have heard Rita asking over and over if Bains believed the Nannies and if he thought they were credible! She never once asked for the nannies to give her false information, not once !
