Now that Howard K Sterns defamation lawsuit against Houston attorney John O’Quinn is tentatively settled, it appears the wheels will start turning in Virgie Arthur’s defamation lawsuit against Howard K. Stern and CBS Studios in the Southern District Court in Houston Texas.
There has been a protective order issued by Judge Lee H Rosenthal in the case, just as there has been in all the other cases that have arisen out of the tragic death of Anna Nicole Smith and her son Daniel.
One of the sections of the order says “confidential information shall not be used for purposes other than in connection with this case”. However, we saw Rita Cosby in New York who is also being sued by Howard K. Stern, freely hand over her deposition as well as those of investigators Don Clark and Wilma Vice to the Florida case.
Howard K. Stern was the only person who objected to having his deposition used from the Cosby case and he is the Plaintiff in both cases. Not too long after, the Florida case is tentatively settled. Could the same happen here?

Ok, now there is a protective order on VA vs HKS,CBS. Does that mean ALL documents going forward will be under seal, or just those that the deposee(is that a word?) request to be under seal? Or does it only pertain to the depositions and documents already under seal in NY?
Did Stern’s attorneys ask for the protective order, or did McCabe? I wonder if Woodie will beg Virgie to settle this one also?
I hope that Virgie never settles. I can’t think that she would. I hope Stern has to pay all of the lawyer fees and also a lot of money to Virgie.

Actually I happen to disagree with you about the suit against CBS, HKS, TMZ, et al. I think what hurt this case from the beginning was having that Seidlin circus being broadcast on national TV (which hurt HKS and VA I think quite a bit with this exposure) and then the bloggers feeding off that fiasco/circus after that. But, in saying that, that was a pretty bold move on Krista Barth and Ron Rale to bring in that “Mommie Dearest video” to gain the upper hand in their case as well. Yes, that clown video followed on the other side but what else could they do after that first video? Huge mistake, I think, to have that Seidlin circus being broadcast on national TV like that. That should have been held behind closed doors. I think also you would not this backlash of bloggers trying to destroy each other like this in the interim.

All of the past few weeks happenings are interesting to say the least.
It is a shame that in an attempt to shut up people opposed to the wrongdoings in Anna & Daniel’s deaths that we are being attacked.
Anything goes in an attempt to cover up for Saint Howie.
For people to claim my site was shut down by the FBI or that I was contacted by the FBI or LE & told to remove Dannielynn’s pics shows the extremes they are willing to go.
NONE of that took place, other than a few of the nut jobs harassing & spreading lies, as usual.
And I suppose when you shut your own site down to revamp it & get the kinks worked out the FBI gets involved, what a freaking joke & illusion of importance they give themselves.
We have already saw Rose, Buttfly & Lyndal risk legal actions for Howie, how many others are going to have to be sued to stop the lies & harassment?

Hi Carole, The document says that “both” parties entered into the agreement for the order, so no clue as to whose idea it was. They also talk about “confidential and proprietary information” so I suppose only what is considered to be that type of info will be filed under seal.
I mentioned as an aside the part about using information from this case in another as they did in the Rita Cosby case for the John O’Quinn suit.
I guess I was wondering aloud if eventually there will be a request to use anything coming out in this Houston Federal in the State case in Texas.
I was also pointing out how to me it seemed odd how the Rita Cosby, Don Clark and Wilma Vice depos were so freely handed over to be used in O’Quinns case but HKS did not allow his own depo to be used in his own lawsuit against O’Quinn. And then boom! Its settled.
And geesh, if Woody offers to settle with Virgie, I wonder if she will accept shoes as payment since HKS says he is broke.
Hi Cat. I was reading all the threatening on Topix and claims that “many spoke to the FBI” and they shut your site down. Glad someone spoke up and said those threats and stories about the FBI could get someone in hot water. People just can not make claims and threats like that to harass someone. Same BS, different day. I would not blame you if you made a call or two yourself.
Cat, keep your chin up. They made similar threats about the FBI to others in the past too. It’s the FBI threats, personal and physical harassment, etc, etc and this is what they’ve lowered themselves too. Not high-standing individuals in society at all I think. Thanks for the response, QV. I think Mr. McCabe knows that Virgie supporters have a keen interest in these Texas suits, and although his first priority is and shall continue to be Mrs. Arthur, I do believe that he will work to allow as much information as possible to remain in public domain.
And BamaCat, gal, you keep doing what you do so very well, and ignore the koolaid drinkers and stalkers. You bring your unique humor to lighten an otherwise unbearable injustice in that no charges have been brought against anyone, yet, in the deaths of Anna and Daniel.
