RE: Brian Cave Class Action Suit

Being that I consider myself to be an honest person and am not afraid to admit when I am wrong, I feel that its only proper to clarify the mistake that I made on the previous article.

I relied on the site www.justia.com on the amount that Cave and company is being sued for. First of all, being tired when I wrote the article, I printed “Trillion” instead of “Billion”. Here is the link to “Justia” who on their site says the Plaintiffs are asking for five billion dollars.  http://dockets.justia.com/

The actual lawsuit document does not list a specific amount of money they are asking for. It does however say they are asking for “more than 5 million dollars”.

When Bryan Cave files their answer to the lawsuit, I will make sure that I publish and write about it. Judging by the number of huge companies such as AIG who are involved in this suit, Justia’s estimate just may be correct if the Plaintiffs previal. However, both sides of the story should be heard. And they will be. I apologize for the confusion.

SH!T!! I read page 4 line 5 and seen the amount of 5 million excluding interest and costs and said to myself “Thats a whole lot of interest and costs” OR QV is sleeping……..LOL.
Thanks for the clarification, isnt it nice to admit when you are wrong unlike some people who spin,twist and makes you so dizzy that you just about end up believing what they say just to shut them up. Some people just cant admit it when they are wrong. ;)

This is why I admire you so very much! You are brave and honest! You set an example for all of us! Thank you for being such a valiant and courageous person. I would imagine that we know some individuals that will just evaporate when they have been proven wrong. I am proud to know you, QV, and I thank you for your efforts! You are the best!

Thank you Mrs Marple. You are one of many hero’s in this story. This is a true labor of love that you all do for Mrs Arthur most every day. And for Anna Nicole and Daniel too. And we all worry about the baby. I was very sad to see that at such a young age, she is going to be in a reality show. I think a lot of people are bothered by it.

$5 MIL. is insignificant for such a big firm.

I agree Jill, the document says IN EXCESS OF $5 million and like I said, with all those companies involved, anyone would think they are going to expect much much more. But of course, that will be decided when and (a big) if they prevail. We still need to read the other sides answer. However it will probably be something like “Defendant denies count 1″ etc…

If you read the documents , it actually states “the amount in dispute is 5 mil plus costs “. The Companies that got screwed, some paid up to 1 mil. in premiums to Insurance Co.,s that were to fund their pension plans. These business owners/plaintiffs were told premiums were tax deductible, Then IRS hit them with Penalities and interest up to 100,000. to 200,00 annually. This is where the “5 mil plus dispute” comes from .The relief these plaintiffs are seeking are “Compensatory and Punitive Damages” to be determined by a Jury !

You are correct, big numbers. To fund employess Pension Funds is serious business. When Employee’s retire usually at 25- 30 years of service, that is what they count on for retirement income. SS benfits only feed the animals not people with real lives and medications that they need to live on. Too many these days people have to choose “food or medicine” it is a crime against Society ! Bryan Cave, etal should be locked up in prision just like the Executives of Enron and others Companies that screw their employees out of their Retirement Benefits.
