Anna Nicole Smith’s mother Virgie Arthur’s conspiracy and defamation case against Howard K. Stern, his sister, Bonnie Stern, Journalist Art Harris, TMZ, Managing Editor of TMZ – Harvey Levin and bloggers Nelda (Rose) Turner, Lyndal (Lynderella) Harrington and Teresa (Butterfly) Stevens is underway.
Arthur’s attorney Neil McCabe has filed a motion to compel Howard K. Stern to produce information requested with exhibits. McCabe has also filed a “Designation of Expert”. Stern has previously filed his objections to requests for documents and information concerning emails and web postings and they are included with the exhibits. A hearing is scheduled for December 10th to discuss the email issues outlined in the documents.
A Mr John Mallery of Kansas City Missouri has been designated as an expert witness who may testify concerning forensic examination of various computer hard drives. His resume of credentials and publications are attached to the document.
With the circumstances being that I am a witness and a “former co-conspirator” who has agreed to cooperate in this case, my personal comments will be limited to preserve the integrity of my probable testimony.
This case will be interesting in many ways as the internet is still young as far as lawsuit precedents and law governing the internet that may be needed in the future.
That being said, you can read the motion to compel and the exhibits in support thereof as well as information concerning the expert witness.

Forgive me, but I just couldn’t handle reading all the details in the document this evening. Did you say that Howie is claiming that those emails are property “of the Estate”? WTF?
Did Anna send and receive emails after she died? Is his “argument” that, since Anna paid for the computers, everything he does on the computer is part of the “Estate”?
Somebody call the Probate Court…lol Or somebody might want to clue Howie in on the fact that he is an adult individual and responsible for what he does and does not do.
Anyone know if he hid behind his mother skirt before he decided to hide behind Anna’s – even after her death?

I love all of his bogus excuses. They are actually quite funny. Keep in mind that we are talking about email exchanges between himself and others after the death of Anna, and the email are specific in that the nature of the exchange was to defame Virgie. How can he possibly pretend that exercise in bad judgment has anything to do with the Estate?
He claims some sort of attorney/client privilege also which is convenient, but not true. He was not acting as Anna’s attorney at her death. He is not licensed to practice law anywhere but California.
He sure likes to change his hat to whatever might suit him, and yet the poor dude can’t seem to get a real J-O-B at doing anything.
He can be quite entertaining. Atleast he does make me laugh…lol

The only things that are part of the estate is what Anna owned while alive, she didn’t write those e-mails, he did, is he trying to say the computer that they were written on belong to the estate, if that’s the case he shouldn’t be using it, LOL. I haven’t gotten a chance to read that document yet, I’ll try to get to it tomorrow but would like to know who exactly has possession, custody and control of all the things being asked for, is it Lin Wood?

Thanks QV, most are aware the “Motion to Compel” Filing by McCabe is not covered under the “Protective Order” which clearly and unambigiously addresses “Discovery Materials” only and must be stamped as “Confidential” per the Courts Order”.

this is just nuts. a) do these people have jobs? (other than just talking about/suing each other) b) didn’t their parents ever tell them to work things out amoungst themselves before runnng to court? the american judical system is not a toy. it’s not here for our amusement. Our torts system is meant to deter “blameworthy” behavior- not personal disputes.

Wow, what a day. Okay finally got to the right court. If you can’t tell, new at this sort of thing.
The women, who was very helpful said anyone can walk in and get those docs. QV has on her site.
Rose was right , not available on line.
The question remains, who does QV know in Texas to go to the courthouse and get those papers,
never mind she is popular in Texas these days.
What the clerk told me to do is write a letter to the judge and make her aware what she did, put in
the letter QV is a witness. We want to make this judge aware of the stalking and bulling.
I will be back later tonight to talk about this some more in chat. Anyone effected by them should
write this judge so she is aware what they are doing to us. I don’t want to be a pain to her so maybe one letter we all can sign.
