Broward County prosecutors are taking a “fresh look” at evidence gathered in the 2007 death of Anna Nicole Smith.
“Our prosecutors have met with representatives of the Los Angeles County District Attorney’s Office and the California Department of Justice and discussed the evidence they have turned up in their investigation,” said Ron Ishoy, a spokesman for the Broward State Attorney’s Office.
Ishoy also said, “We are now examining that evidence to see where it might lead in relation to Ms. Smith’s death here in Broward County in 2007.”
Ken Padowitz, a former Broward County homicide prosecutor said, “If the Broward State Attorney’s Office finds evidence one or more people supplied Smith illegal drugs that caused her death, a charge as high as first-degree murder could result. Another possible charge could be manslaughter by culpable negligence. In that scenario, prosecutors would argue there was such a high degree of negligence in providing Smith drugs illegally that it became a criminal act.”
Prosecutors “may present this case to a grand jury to determine whether or not this is a first-degree murder case or any other type of criminal violation,” Padowitz said.
Ishoy speaking for his office said they “never had an open homicide investigation” in Smith’s death. He said, his office provided assistance to the Seminole tribal police where the Hard Rock Hotel is situated on the Seminole Indian reservation.
Ishoy also said the inquiry by the State Attorney’s Office is related to the arrests of Howard K. Stern and Drs. Sandeep Kapoor and Khristine Eroshevich.
Broward County Medical Examiner Joshua Perper said today that his office is not involved with the re-examination.
California officials “submitted documentary evidence which is being reviewed by the [Broward] State Attorney’s Office and at this time we don’t have any involvement at all,” Perper said.
Representatives from the State Attorney’s Office in California submitted the information to the Broward State Attorney’s Office a month or so ago, he said.
Dr Perper said Anna Nicole died of an accidental overdose of prescription drugs, with an infection and possibly the flu contributing to her death. However it has been pointed out on national television that Perper partially relied upon Dr. Khristine Eroshevich who had a personal interest in the outcome of the examination. She was recently arrested along with Howard K. Stern and Dr. Sandeep Kapoor for felony drug charges in connection with Smith’s death.
Smith died from a lethal combination of anti-depressants and anti-anxiety medications, antibiotics, Valium and chloral hydrate, a rarely prescribed sedative, authorities said.
Perper ruled out homicide at the time, but prosecutors could argue against that if they find new evidence, Padowitz said.

My goodness, it’s finally happening, and I’m almost aftaid to hope that Florida will step up to the plate and hit a home run. I would love to see Howie be charged with reckless homicide. Heck, I’ll even go for Capital murder. I have no faith in the Bahama’s although I’m told that there’s a chance we could have Daniels death re-investigated. I’d just as soon they let us bring him and Anna home, where they belong, and mete out American justice….I’m singing RICO
So, the whole recusing thing is due to a testimony by Rose? I find that unbelievable. But I don’t really care who the judge is (although Rose seems to) let’s just get the show on the road.

Those docs were so interesting!! For the first time I actually missed not being able to read over there, just to see what she has to say. OMG…I’d be begging for my corner, right about now out of embarrassment, and shame. But her being such a calculating, manipulative, narcisstic, gossip, she’s probably already working out her next plan to save herself.

Of course, I can say, these people, and I say people because I don’t want to print any bad language are still looking at the so called inheritance. I for one minute do not believe HKS is letting that go, although it seems quite certain to me he will never see it. I truly believe that is the only thing that is motivating him to keep going instead of copping a plea.
I guess that tells us exactly what Stern got out of the FL settlement, doesn’t it? Nada. But I do believe in the million or so ET’s paid him…and that is just the start of the money tree. IMO
I also do not believe him or his sister are broke, but well hidden at this point.
