Judge Lindsay held a telephone conference today as a result of the emergency hearing filed by Howard K. Stern’s counsel Lin Wood.
Judge Lindsay will not hear the motion for sanctions. She said since it involves the recusal which was denied, the issue should be brought before Judge Underwood.
Tomorrow Judge Lindsay said she will hear the motion of Art Harris to “clarify” the order to turn over his computer. Also she will decide whether and when to hear the motions for contempt on Bonnie Stern, Art Harris, and Lyndal Harrington.
Judge Lindsay will also hear the motions to compel Howard K. Stern and Teresa Stephens and Nelda Turner to turn over their computers.
The Judge said she will not hear Teresa’s motions (injunction, whatever), because it has not been properly served to the required parties.
One more note;
Bonnie Stern’s motion for reconsideration has been DENIED by the California bankruptcy judge and this was done before McCabe could file any opposition.

The motion to compel Bonnie Stern was granted in January.

Well, good news about Bonnie, and mixed feeling towards the rest. Teresa hasn’t properly served everyone…why does that not surprise me. And I figured Woodie would get his delay. The statement regarding contempt charges is puzzling; it indicates that the judge hasn’t made up her mind whether to hear them or not….but they are listed on the court docket. QV, do you know anything about those 2 pre-trial hearings that were rescheduled?
Hi Carole, I don’t know anything about those. But its good she is taking one step at a time. And will review everything carefully. Then there will be nothing to appeal when they all get their butts kicked.
this has been going on for almost a year or more. Wood needs to be sanctioned NOW.
I agree QV, Judge Lindsay is airing on the side of caution. I would prefer that Judge “Motion is Denied” Underwood, handle the Sanctions. He is not going to be at all impressed that Lin Wood lied to the Court about having a Mandantory Event in another case which was verified as being a lie. Let’s all keep in mind ,that while Judge Underwood has not imposed many Sanctions in the past , it was/ is a very serious matter accusing a Presiding Judge of “Judicial Misconduct” without a shread of evidence and even more so to come from a “Pro Hac Vice” Georgia Attorney.
