Mother of Anna Nicole Smith – Virgie Arthur Designated Next Of Kin Status To Her Daughter In CA Felony Drug Case Against Stern, Kapoor and Eroshevich.
Via a filing in Virgie Arthur’s defamation and conspiracy lawsuit in Harris County, Texas, we learned from her attorney Neil McCabe that Mrs. Arthur has been designated the Next of Kin for her daughter Anna Nicole Smith in the felony drug charge case against Anna Nicole’s lawyer Howard K. Stern and two of her doctors Kapoor and Eroshevich.
Most of us remember watching the televised hearing featuring the battle to bury Anna Nicole. We saw that Mrs. Arthur was just about completely shut out of any decision making concerning her daughter. Florida statute says the spouse is the next of kin for estate purposes and then the children over 18 of course as far as decision making goes.
Its true that Anna Nicole had one surviving child, an infant, but there was a battle as to who the father was and who would speak for Dannielynn. Howard K. Stern and Larry Birkhead both claimed to be Dannielynn’s father. In the end, a guardian ad litem was appointed to make the decision for Dannielynn. The G.A.L voted with Stern and effectively shut out Mrs. Arthur.
Now, after a two year investigation by California Attorney General Jerry Brown’s office, with some help from the DEA, Marsy’s law will involve Mrs. Arthur in the prosecution and possible conviction of those who broke the law to illegally supply Anna Nicole Smith with the drugs which caused her death.
For Mrs. Arthur, it will give her the right to be informed of all proceedings, the right to attend them and to have her representative attorney Neil McCabe with her, including attending jury selection. She will also have the right to give a victim impact statement.
Here’s the kicker. Dannielynn also has the right to be represented and can apply for next of kin status under Marsy’s law. Her father Larry Birkhead would have to do that for her. So the question is, will he? Will Larry Birkhead declare his daughter to be a victim of Howard K. Stern’s regarding the death of her mother?

I have the feeling he won’t do that against Stern. I am so happy for Virgie. I am so proud of the way she has handled herself through all of the cases. May God Bless her.
Larry took a left turn back in the Bahamas. He’s much to chicken shit to say anything against Stern because of the “deal” and whatever Stern is holding over his head. Word is he was not at all cooperative with the investigators.
Larry will sit back and wait to make a move after Stern is convicted and removed as executor of the estate. Then it will be more natural that he “step to the plate” to handle any legal matters rather than make any move against Stern who Larry fears would destroy him.
Right now Larry is “jockeying” for the best position for himself, not Dannielynn. That’s okay. Virgie, as the next of kin in this matter, has her back.
Does that mean that Donald Hogan (or even Donna Hogan) could get a “designated next of kin” status?
After all, Donald was bio father, though he was estranged just like Virgie.
I don’t think Birkhead is in position to do anything since he gave drugs, Ecstasy and cocaine to Anna Nicole. Not to mention other dirty things Birkhead did to Anna Nicole.
One would hope that Larry Birkhead would always put the interests and welfare of Dannielynn before his own, and therefore would declare for his daughter. However, one must also remember that whatever Howie used to sway Larry to do an about face when Anna died is apparantly still holds sway over Larry, IMO. It makes me wonder exactly how Larry was involved with Anna other than being the donator of the live squigglies. I’d urge Larry to step up and be a man, but….oh, never mind!
Carole I agree that the deal is still in place with Larry and Stern. For whatever reason Stern owns Larry. IMO Larry has needed to grow some forever but he just can’t. What could it be that Stern still holds over him? It would not surprise me to find out he was just a sperm donator but now so what! Who cares now? I don’t. Who cares if he is gay? I don’t. So what could it be?

I’m not sure what if any, good it will do for Virgie to be named next of kin but I’m so glad that it was done. That is a title that no one else can claim at this time. Eventually Dannielynn will take it from Virgie but right now, she’s it! Bet that just galls Ole Howie and Larry both.

HA- congrats, Vergie. Yet another opportunity for media attention. However, a word of advise, don’t be too pursuasive if asked to testify against HKS- remember, this same man who will stand trial for his involvement in your daughter’s death is also one of her attorneys in your quest for a piece of the Marshall estate. This must be a huge concern- which one is more important? Avenging your daughter’s death, or winning a piece of an estate to which you have NO legitimate right…ok, well, I guess it’s an easy decision for most of us. Or, perhaps she’s hoping that they can steal the estate without him- maybe this could be the only way to illiminate his heafty claim (in the form of leagal bills) to the potential winnings.

Hi MJP. I must say I have not seen on thing in print or media where Virgie says she is going after the Marshall money. In fact she has said just the opposite and that its “tainted money”. I do know she would like to see her precious granddaughter though.
Virgie going after the Marshall money has been the theme song of Howie’s supporters since day one, it seems. And I have to laugh every time I see one of them say that Virgie isn’t entitled to any of the Marshall fortune. Well of course she isn’t! No one but the Marshall family is! Why would anyone in their right mind think that Howard, Larry, Virgie or Dannielynn is entitled to another family’s money? I feel sure that Virgie has no interest in other peoples money. She seems to be the only person in this whole mess who ever worked for her OWN money.
