There has been a 68 page opinion rendered by the 9th Circuit Court regarding Anna Nicole Smith’s battle for her late husbands estate in re: Marshall v. Stern and the estate of Vicki Lynn Marshall aka Anna Nicole Smith.
Just a precursory look at the document indicated that Anna Nicole Smith’s estate will walk away empty handed and so will Howard K. Stern and all the lawyers in various parts of the country that Stern apparently owes money to, according to statements he has made.

We conclude that the findings of the Texas probate court should be afforded preclusive effect because it is the earliest final judgment on matters relevant to this proceeding. The bankruptcy court exceeded its statutory grant of power and constitutional limitations on that power when it purported to enter a final judgment in favor of Vickie Lynn Marshall on her counterclaim….

Statement From The Family of E. Pierce Marshall
DALLAS (March 19, 2010) – The U.S. Court of Appeals for the Ninth Circuit today vindicated the efforts of the late E. Pierce Marshall to uphold his father’s estate plan.
The Ninth Circuit opinion supports the 2001 95-day jury trial in Texas Probate Court, which established that Anna Nicole Smith was never entitled to any assets from the Marshall family beyond the $7 million in cash and gifts she received from J. Howard Marshall, II . The jury also unequivocally rejected Smith’s claim that E. Pierce Marshall and others interfered with her receiving any additional gifts while her husband was alive or at his death.
“The lies that were told about told about E. Pierce Marshall have finally been put to rest,” said a statement issued by the Marshall family. “Pierce Marshall was never intimidated by Anna Nicole and her bevy of contingency fee lawyers’ use of her celebrity and the legal system to try to loot J. Howard ‘s estate. We are proud to have supported his efforts and continue that -fight. Our only wish would be that Pierce were here to see his vindication.”
“Many people have asked over the many years if the -fight to uphold my father’s last wishes was worth it,” Pierce Marshall said in a statement issued in 2004. “I know Anna and her lawyers were counting on our family giving up and paying them an absurd sum to go away. That was never going to happen. We never wavered from our belief that, in the end, justice based on the rule of law would prevail.
“We are deeply appreciative that the Ninth Circuit took the time to closely examine the important legal issues raised by this case and agreed with our analysis of the law and facts regarding those issues,” said G. Eric Brunstad, Jr. who represented the Marshall family.
“Anna Nicole Smith and her attorneys never presented a single witness on document that upheld her absurd claims,” said David Margulies, a spokesperson for the Marshall family.
“Texas jurors in the Probate Case listened carefully to all the evidence Smith and her lawyers presented and ruled in favor of E. Pierce Marshall on every point.”
The 9th Circuit upheld the Marshall family’s argument that the case has been fully adjudicated in the Texas Probate Court, which ruled in favor of E. Pierce Marshall and against Smith on every issue. The 9th Circuit ruling states in part: “The district court should have afforded preclusive effect to the Texas probate court’s factual findings and relevant legal conclusions.
The determinations adverse to Vickie Lynn Marshall in the Texas probate court prevent her from establishing the elements of her counterclaim, such as J. Howard Marshall II’s intent to give her a substantial inter vivos gift, the tortuous nature of Pierce Marshall’s conduct regarding the estate planning documents, and the reasonableness and amount of her expectancy. We reverse the judgment of the district court and remand with instructions that judgment be entered in favor of the Estate of Pierce Marshall.”

The losing side can see if the Supreme Court wants to hear it or ask for rehearing by the 3-justice 9th Circuit panel that issued the opinion or the 9th Circuit en banc. En banc rehearing rarely is granted in the 9th Circuit and, if it is granted, means that 11 justices will rehear the case. Even more rarely, all of the 9th Circuit justices will rehear a case. If all of the judgeships are filled, that would mean 29 justices rehearing the case, but the court’s website shows 3 vacancies right now. I once argued on rehearing en banc in front of 17 justices in the 5th Circuit in New Orleans. That was the first time that all 17 judgeships were filled at the same time and all 17 sat for oral argument. See the rules (35-1 to 35-4) that govern rehearing.

The Washington Times reporter is light on insight and essentially repeats the tabloid version of the facts. As Justice Ginsberg wrote, this is not a Probate case. It is a case where E. Pierce pursued ANS to CA and sued her for defamation (adversary proceeding within the Bankruptcy case). Pierce lost; long past time to pay up $88 million plus interests and costs!

Actually ANS lost because the TX probate case has preclusive effect, thus no tortious interference with a inter vivos gift, since the TX probate ruled there was no such gift to be interfered with.
The defamation part had nothing to do with the money award for ANS. The defamation part was to have Peirce Marshall’s defamation award declared “non-dischargeable” as McCabe has done in the Bonnie Stern bankruptcy.

I will admit it’s hard to understand this case from a legal point of view but from an emotional point of view it feels very sad to see Daniel being drug to the supreme court in the articles picture, my gut says that young man didn’t want to be there.
In regards to the 88 millions is that a separate case? I understood it as these are two legal battles and only one is loss.

What great news! What a glorious day in the neighborhood. Congratulations to the Marshall family. I cannot convey how happy I am that Stern/Rale/Birkhead did not see one single penny from that family.
I have long awaited this day as I believe it to be the “biggie’ when it comes to Howard Stern. No way can he buy his way out of the Criminal Case now or any other case as a matter of fact. No way will he ever live comfortably even after he loses his law license and gets out of jail (barring some sort of plea deal and light time and /or probation which everyone is offered but he won’t take because he’s that stupid.)
Down in Southern California tonight there is the wail of outrage, shock and disbelief with a flood of tears as they learn they couldn’t pull off the “big heist”. Big, BIG loss for Howie. How will Stern pay all of the CRIMINAL lawyers? How will he pay his parents back? How will he get some new shoes? Wait…the shuffling of paper and the ringing of telephones. An appeal of course. There must be another angle to get their “dirty” mitts on the money. Mistake of law!!! The judges reviewed the wrong case!!! Yes, Stern/Rale, swims can banter about all they want and even appeal but the bottom line is……no money honey. IMO They can even appeal to the Supreme Court but it will get tossed. As for Mr Birkhead….well he has been living as if he already had the money in the bank. However Birkhead says he never counted on the money, that it was a "pipe dream". 1. Virgie did not “get” a big time attorney. O’Quinn offered his services pro bono.
2. If you will remember, paternity was not established until the test was ordered by the Bahamian court. Of course she attempted to get custody of her granddaughter and it should have been granted until the test results were established.
3. There has never been one single claim or challenge to Anna’s estate from Virgie. There has never been one single claim to anything to do with the Marshall estate by anyone except PIMP DADDY- Larry Birkhead and I WILL WORK FOR SHOES UNTIL I GRAB THE MARSHALL BILLIONS—Howard K. Stern!
4. Please show proof of your accusations and show any claim by Virgie to any estate or estate money before you go shooting your mouth off.

AFTER the results were made public,of D.L’s D>.N.A. OQuinn was on national television saying that Vergie wanted custody of the granddaughter, and that Larry could have visitation. They tried to get the Bahamian court to stop Larry from taking D.L. to the U.S. because they thought he would not bring her back for the court date. That is why Larry is not friends with Vergie . Actually Vergie asked that Larry leave D.L. in the bahama’s with HOWARD,. I know what happened through this, and I have not forgotten. I went through the whole thing, and I don’t care what side you are on ALL the TRUE FACTS should be brought out . NOT just the ones we want .
I love it that everyone seems to be salivating that Howard, Larry and Co. are not getting the Marshall money. It wasn’t just Howard, Larry and co. It was Virgie too. Just google Virgie’s name and you will find tons of blogs and posts and articles about everything that happened from when Daniel passed away and leading up to when Anna met her demise. There were NO winners here except the Marshall Estate. I never thought Anna should get anymore than what she got when she was married to Marshall. I was one of the bloggers here back when this all started and I have been silently sitting back and watching and listening to everything as everything unfolded, blew up, became hostile…. friends becoming enemies. Supposed friends on here and other blogs sneaking and making up things just to corner someone else and bring-em down. Just when you think it couldn’t get any worse, here comes Virgie Arthur to lay claim to her daughter’s body and baby. It never ceases to amaze me what extremes some people will go to for money. Anna Nicole hated her mother Virgie Arthur and let the world know it on more than one occasion. Watching Anna break down in tears over the loss of her son Daniel tugged at my heart strings. I, too am a mother of four children.
The relationship between Anna and Daniel was always strong and unwaivering. The relationship between Virgie and Anna was non-existent. Anna openly admits of suffering physical and mental abuse at the hands of her mother. Anna chose to have no ongoing relationship with her mother. When Daniel died, Anna said she did NOT want her mother to attend the funeral or be anywhere near her, or her son’s grave. What did Virgie do? Virgie did what any money grubbing person would do. She accepted a $50,000 payment,from a media source, and traveled to the Bahama’s to be photographed sitting on top of Daniel’s grave. Anna shared her anger and outrage on camera, for millions of viewers to see, with Pat O’brien, host of “The Insider”.
Virgie KNOWS that Anna didn’t want ANYTHING to do with her. Virgie KNOWS that Anna had felt this way for years. Virgie KNOWS that if Anna were still alive she would never be given permission to see her grand daughter. Virgie also KNOWS that Danni Lynn is the sole heir of potentially half a billion dollars. Suddenly Virgie has turned into June Cleaver and wants custody of the baby. Suddenly Virgie is feeling maternal and wants to claim her daughter’s body.
What kind of SICK person is Virgie Arthur? After the loss of her grandson, and her daughter you’d think that NOW is the time to honor her daughter’s memory. Virgie is letting her true colors show. She thinks that she’s coming across as the grieving, caring, always loving mother and grandmother. All I can see is a money hungry witch that’s willing to go against her own dead daughter’s wishes. I’ve tried to find an answer or motive that would justify such behavior. There is NOTHING when your the kind of person that lives life with some morals and values in place. Virgie Arthur is driven by greed for money, and attention.
Do I sound harsh and unfair? Perhaps to some people I might. However, my thoughts are fueled by one source. Anna Nicole’s public opinion of her mother. Anna HATED her. Anna shut Virgie out of her life for reasons all her own. Anna was a 39 yr old woman. Virgie might not like the choices that Anna made in regards to allowing her to see the baby. Virgie couldnt respect her daughters feelings in life, and now in death. Virgie seems to have a lifetime pattern of neglecting and ignoring her daughter’s feelings. Why stop now that Anna is dead?
The media has turned this tragic death into a circus sideshow. Everything is blown out of proportion, speculated, and very little is based on fact. Its a shame. It really is.
Virgie Arthur needs to fly back to where ever it is she came from and crawl back under her rock. She needs to let Howard claim Anna’s body. Purely based on KNOWING that Anna would want it that way. As for Virgie wanting custody, she needs to realize that Anna HATED her as a mother, and would NEVER want Danni Lynn raised by her. The thought of millions of dollars means more to Virgie than respecting her daughter.

What is your opposition to the grandparent wanting custody of the child? At the time LB was not living with Anna. Virgie was emotional, she lost two family members. Are you saying because she was grieving and reaching out to a love one it gave stern the right to harm her in the way he did?
The real question is why has Larry changed his position in regards to stern and what was going on with Anna? It comes off as vindictive, manipulative and very cruel. His actions may very well cost him a lot, my opinion , he is much like the stern groupies and his behavior is foolish. I hope he acts in the best interest of the child but don’t think he will. He seems very selfish and self centered with a weird sense of being popular when reality he’s not and the reason is because of his inability to work it out with his daughters family.

I suspect that during the burial hearing Larry was playing Virgie. By the time Virgie asked the court to keep her granddaughter in the Bahamas with Stern, his whole family was squatting in the Thompson house and of course with the media attention, her attorneys figured the baby would be safe to remain in the house.
Karissa, you will not find one single legal document where Virgie wants anything to do with her daughters estate which includes the Marshall case. She said that money is “tainted” and wants nothing to do with it. John O’Quinn was a billionaire and did not need the Marshall money. When he died last year, he left his money to charity. The O’Quinn law firm is now an arm of a charitable organization. All profits go to abused children, and the many other good causes he supported.
Anna was an unmarried woman when she died. Logically and lawfully, her mother should have been able to claim her body. Anna’s will did not state her wishes for burial. And then Daniel would have been moved out of that country too. Daniel did express his disdain for the country of the Bahamas when he told Ray Martino, “don’t leave me down here”.
It is not true that Virgie and Anna’s relationship was non-existent. Virgie and Anna Nicole spoke on the phone and kept in contact sending cards and letters too. The drugs were a cause for tension between them. Imagine watching on TV, your own daughter bombed out of her mind as we have seen several times. Who put her out there in front of millions of people to be made a fool of? Stern, of course. Larry pimps that kid out every chance he gets and has reaped millions of dollars doing it. Funny that he complained about Anna doing the same thing. A mother just knows. And this mother knew that her daughter was in grave danger. She was so correct. She was trying to reach out to her this way because all other lines of communication were cut off.

Anna was getting her prescriptions herself years before Howard Stern came along.She used many names. She had her personal laptop that she would use to order meds in any name she could including Howards.Anyone who went against her about anything, was ousted from her life. Everyone of us who was here from the beginning saw all the facts, not second hand posts. Anna was with F.S. and family, in N.C. and He carried her duffle around.Dr, E, knew more than I believe even Howard at the end.Anna was relying on her for EVERYTHING, why she left Anna at ther time she did is a mystery to me. But there are so many stories about that time, many from Moe and his wife, changing their story to accomodate who ever would pay them. The last thing Howard needed was for Anna to die. They should have called 911 before Dr.E left and had her taken to the hospital. there aRE too many personal feelings guiding posters. Just keep to the REAL Facts, not what you want them to be. The real facts are all out there, so instead of using the posts you read go to the beginning and read everything. I have done that many times and still do. I have not changed my stand because of this. I have friends who have changed, but they are still my friends. We do not have to think alike. We just try to stay away from subjects we disagree on. Or sometimes we do talk about it. I stayed here, and watched others like Mary, leave and totally trash Qv, and others who stayed on this site. How she has the nerve to come back and kiss a– is beyond me,. I just know I will never acknowledge any thing she says.
