I have not had the chance to read all of this yet but what I have read of it pretty much says it all. TMZ published an article about Anna Nicole Smith’s mother Virgie Arthur that was not true.
In her complaint, counsel for Mrs. Arthur has in their possession an email that Howard K. Stern’s sister Bonnie sent to a blog owner, Nelda (Rose) Turner.
The email in part…
…Howard told me this morning that Larry was actually the one who intentionally leaked to TMZ the thing about Virgie and then Harvey Levin looked up and found the family tree…
…He (Howard) said that Larry leaked that because of the amount of viewership TMZ gets and it turned in their favor against Virgie that it happened so it was actually a good thing…..
He (Howard) didn’t understand why everyone was so mad so I told him that Art (Harris) wanted to break that story…He said he would have Art break the one above yet he doesn’t get a lot of viewership…They need the high viewership of TMZ at times…

The “Larry” who is referred to is Larry Birkhead, the father of Anna Nicole Smith’s baby Dannielynn. It appears that he gave this information to TMZ to publish in order to ruin Mrs. Arthur’s reputation. The Stern’s and Birkhead do NOT want Mrs. Arthur to know her granddaughter Dannielynn who is the only remaining person alive after the mysterious drug deaths of her mother Anna Nicole and brother Daniel.
As you can see from the exhibits, a lot of other websites picked up and copied TMZ’s libelous story subjecting Mrs. Arthur to world wide scorn and ridicule for something that did not happen as TMZ portrayed.
Journalist Art Harris is also mentioned. He was apparently upset because he was not chosen to distribute this false information as one of his “exclusives”.
Many do not know that Mrs. Arthur was a 26 year veteran deputy of the Harris County Sheriffs department. Also included are affidavits from a former supervisor and co-worker. Below is Mrs. Arthur’s response to TMZ and Harvey Levin’s motion for Summary Judgment.

Well, I must say that of all the defendants, Turner is the only one who is doing the right thing. Everyone else is trying to skate out of it on technicalities and court rulings. Wonder when the rest will start pointing fingers at each other.

QV, this is just my opinion, but if Turner did the right thing to begin with, I think a lot of this hate fest too would have avoided. If what she is doing now is doing the right thing to help get to the bottom of this mess, then that’s wonderful. But, there are certain things that have been done which is hard for me to let go of as well IYKWIM and I think maybe I can speak for others too. My hope one day is that this ridicule of Virgie dies down IMO. I saw the note that her superior officer wrote who was a work colleague and I thought the note was wonderfully written which depicts a hard working woman with integrity and also from what I saw a pretty established career in law enforcement.

Clues I totally agree with what you say. Have you read Harris response to Arthur’s requests for production and interrogatories? He thinks that he is off the hook. I can’t wait for that smack down :-)

It’s about time. I was sweating bullets ’cause I knew McCabe needed to respond to TMZ. I think it was worth the wait. Thanks for posting these QV.
God, but I notices the court reporter only billed for a few hours for Nelda’s deposition. I was under the impression this was going to last for several days. Do you have any information regarding this?
And the excerpts I read were very funny. I think the room must have sounded like popcorn popping with all the objecting going on!
My heart actually broke for Rose when I read her depo. knowing how much she cared for Bonnie. I loved Rose and probably still do, I get what happened to her.
Clues the “hate” was part of what happens when people like the Sterns use groups. IMO they completely understood group mentality and manipulated the bloggers. It was a free ride for them, a way to use others to promote an agenda, it’s PR work and it’s dirty. Rose, QV, Havana, you, me and so many others got caught up in this and we can’t blame Rose or anyone else IMO we have to understand what happened to us in order to arm ourselves from it happening again. IMO we need to start being logical and stop blaming one another. We all enjoyed Rose when she was doing what we wanted is the truth. I tried very hard to protect her from the hate but her need to be liked by the sternies turned her against me. It was very disturbing and I won’t say it didn’t hurt because it did.

Woody tried to filibuster but McCabe just kept on asking and Nelda kept on answering in spite of all the noise. I definitely would have paid good money just to be a spectator for that show.
Mary, I appreciate your comment but we all have to accept responsibility for our own actions. Myself included of course. As each new piece of the puzzle comes to light I see more and more of what happened and its stunning to me that I was absolutely correct in what I guessed was going on. Its also sad and I have lost a lot of faith that I had in what I thought was the decency of human nature.
I also have taken responsibility for my part and know that I did a lot of things wrong. The first was getting involved in the first place and the second was that I thought I could judge a book by its cover at the very beginning. I’m still here until its over and I hope there is a happy ending for those who deserve a happy ending and became victims of the greed of others.
QV, some of us have taken responsibility and others are still buying into the VA is evil chant. I just think it’s a matter of being able to recognize when you are wrong and admit it. Some people can never admit to being wrong and have to always be right and they get stuck. There is not one human being on this earth who doesn’t make mistakes, it’s how we handle ourselves when wrong shows our true character. I witnessed what happened to the HKS who dared to ask and endured the abuse myself for doing so. It’s creepy the way we are treated for forming an opinion especially based on proven actions.
You endured a lot QV and for all you have it made you stronger and better, that’s what I see.
BTW, I thought it was a riot too the way Rose kept on answering the questions and am very proud of her for what she did knowing it had to be difficult for her.
Oh, one last think is they will never take from me my faith in the decency of the human spirit, you and many others gave it back to me. God Bless.
