More pre-trial motions must have been discussed today in the felony drug trial of Howard K. Stern and the two doctors Eroshevich and Kapoor. I can’t imagine how Mrs. Arthur must feel right now knowing that the judge said the death of her grandson Daniel Wayne Smith is irrelevant.

der what was brought up today in court concerning his death. I guess the fact of “if not for the Methadone, Daniel would not have died” does not matter.
It also must not matter that Methadone was carried into the Bahamas illegally by one or more of the persons who are on trial. It must not matter that when Anna Nicole got to the hospital to give birth, reportedly Stern did not take the video camera and had to go back to fetch it before the c-section was performed. What else did he fetch? It must not matter that the Methadone that killed Daniel didn’t walk into the hospital all by itself.
Will anyone who has the power ever care about what happened to Daniel?

I do think and hope that information about the drugs being transported to the Bahamas will come in.
After all it is part of the overt acts and the only one of the accusations in the overt acts that was dismissed by the Judge in the preliminary hearing was the one about Eroshevich giving ANS a placebo as there wasn’t enough evidence to support that one.
Which is actually funny since that one might have helped her case a bit. LOL

The first day of questioning prospective jurors in the Anna Nicole Smith drug conspiracy case has ended with most of the possible panelists eliminated.
Superior Court Judge Robert Perry finished Monday’s session by ordering another group to report the following day after attorney challenges excluded all but a few of the first 60 perspective jurors to be questioned.
Among those removed was a Scientologist who said he believed psychiatry was a fraud and a fan of Smith’s reality TV show who said the Playboy model’s boyfriend-lawyer, Howard Stern, did not do enough to save her from drugs.
Do you believe they went through 60 people today? I don’t.
It’s possible, I suppose. If several admitted a bias, or were eliminated due to something they wrote on the questionnaire. I am sure that both the prosecution and the defense had already determined some that would be eliminated due to answers on the questionnaire prior to the start of todays hearing if they were able to go through the answers beforehand.
Does seem like a lot though. Although one article said it was 52 people.

Still seems like that would be a lot. Although at times they will ask questions of a group then after some are eliminated based on the answers in the group setting, then they will do the more one on one questioning. I don’t believe they did one on one questioning of that many potential jurors in one day, many were likely eliminated in the group questioning.

One thing I find kind of funny is that the reports say that evidence of ANS’s death and Daniel’s death will not be allowed in at trial, which I understand to a certain degree since the defendants aren’t charged with their deaths, however some act as if the deaths won’t be mentioned at all. Yet in the questionnaire on page 7 it specifically mentions both of their deaths. Thus the deaths were mentioned and brought up even before the selection of the jury. If there was a prospective juror who didn’t know about ANS’s death, or the more likely didn’t know of Daniel’s death they would have learned it from that. LOL

I wonder what a “few” panelists remained means? Four, Five, Six? They only need 12 plus a one or two as alternates. I wonder how many challenges the defense used up? If I remember correctly they only get 10 peremptory challenges in a criminal case.
The prospective jurors > the Scientologist and the woman who didn’t like Stern and thought he should have done more to help Anna would have been easily removed. I guess it’s safe to assume the guy who said, “where their is smoke there is fire” also got booted. Darn It! LOL!
At this rate jury selection may very well go into a third day. Let’s hope they saved the best for last and many of the defense challenges got used up.
Well at least Stern got to see first hand it’s not just some crazy bunch of bloggers that think he’s a piece of sh…! The “common man” who knows very little about all of this thinks very little of him and they haven’t even followed the case in-depth like many of us have. Anyways, I hope he and the doctors had a terrible day in court with many, many more to come.
Oop, Just Guessing, I just wrote a little article about that. Interesting to see how jury selection works. I agree with SheStone, that there could have been a group dismissal. That and other issues could have gotten them through so many today but its hard to say without being there.
SheStone, its confusing isn’t it? One way or the other, all prospective jurors know that ANS and her son died from drug overdoses and the trial is about illegally obtaining the drugs that caused their deaths. But yet its not. I guess you would have had to live in a cave to not know about Anna Nicole. It was everywhere for a long time.
With all the hard times people in this country are having, I think there is not a lot of tolerance for special treatment for celebs.
Personally I see what is going on affecting each and every one of us. Extra paperwork and scrutiny of doctors, increased medical care costs, refusals to treat pain or psych patients and where I live, doctor shortages because the insurance costs are too high.
Things do need to change so we shall see.
