Howard K. Stern’s attorney Lin Wood was present in Harris County court today in Virgie Arthur’s libel and defamation lawsuit against Howard K. Stern, Bonnie Stern, Larry Birkhead, Art Harris, TMZ, Harvey Levin, Nelda “Rose” Turner and Lyndal Harrington as was Luke Lantta.. Neil McCabe was there for Arthur. Nancy Hamilton was there and her husband Chip Babcock was on the phone for Art Harris. Nelda “Rose” Turner pro se attended by phone.
Mrs. Arthur won her motion for continuance. The trial will be reset to sometime in February 2011. So that pushes back the discovery date as well. Stern’s motion to discard the Rule 11 agreement was not granted nor was his motion for Special Appearance.
The case is stayed as to Stern until the court of appeals is finished with Arthur’s motion for rehearing. Nelda Rose Turner’s motion to designate Art Harris company Busy Street Productions was granted and Arthur’s motion that will be filed in the future to join BusyStreet will be granted.
TMZ won their motion for summary judgment and are out of the case unless Arthur decides to appeal.
All in all, today was a good day for Mrs. Arthur.

Just to clarify.
Are you saying Stern lost his special appearance and the court ruled it has jurisdiction over him, or that they didn’t hear it today?

Yes, thank you for the update. Hope you don’t mind that I posted it on Topix. I find it interesting the Harris County case continues despite all of the defendents lies and objections. The trial has been set for 2011 which mean things are still going forward. It will be really sad (not) if Stern has to give his deposition from prison.
I thought I read that McCabe wouldn’t be there. Must have been a big surprise for the “D” team. Truely, a good day for Virgie and her legal team. Art Harris really deserves to be in all the way. He was the right hand man to all of this damage.
Glad to hear everything is stayed until the Court of Appeal rules. Wood wasted a trip to Texas. LOL! Hope he charges beaucoup bucks to Stern.
Now Stern, the mastermind of all of these plots, has to continue keeping his eye on what is happening in Texas while he sits on the hot seat in California. If/when California pulls him a conviction then he’ll have Florida to worry about as well.

Hi SheStone, They delayed everything as to Stern. He did not win or lose anything. As you saw the motion for continuance was granted so there are no more time constraints like Harris’s people tried to manufacture. I suspect they will probably get away with stealing discovery that they had no business having their hands on. Just like CBS demanding things back from McCabe in Federal suit. I guess they didn’t have enough class not to spread it around. McCabe did as he was asked. I have no reason to doubt any judge but I am going to take a big old guess that this one has not done his job reading like he should have. I can’t see how anyone up on the case could issue a no evidence SJ. I can see it for CBS but not for TMZ.
