Remembering that we must depend upon unreliable main stream media to provide news of the trial, here is what we have seen so far.
Whats in…
- Howard K. Stern’s sister Bonnie Stern and Anna Nicole Smith herself will be considered uncharged co-conspirators.
- The little girl, now 13 years old who is in the infamous “Clown Video” will testify that she saw Stern give Anna Nicole something from an unidentified bottle.
- Photos of Dr. Khristine Eroshevich and Anna Nicole Smith naked in a bath tub may be allowed in, however Judge Perry requested more documentation. Three photos on the hard drive of Smith’s laptop show her and Eroshevich naked with arms around each other in a bathtub, according to an affidavit. One of the reported photos has Anna Nicole sitting spread eagle in the tub with Eroshevich sitting between her legs. Boobs to back, crotch to butt and Anna Nicole’s hand reportedly on or very near Eroshevich’s crotch. I hope those are not the photographs which Judge Perry called “playful”. Where I come from, its called “foreplay”. The photos are dated two months before Smith’s death*.
- The judge said he might allow brief snippets of a video showing Dr. Kapoor making out with Anna Nicole Smith during a party.
- Smith’s slurring slush mouth appearance at the 2004 American Music Awards, is allowed.
Whats out…
- Judge Perry said any evidence from Florida connecting the three defendants to the death of Anna Nicole Smith would not be permitted because Florida did not prosecute anyone. Officials in Florida dropped the ball and did not file any criminal charges against anyone in her death. Perry wanted to know why Florida was not handling this case.
- Also excluded was a 1996 television interview showing Smith leaving the Betty Ford Center after being treated for alcohol and drug addiction. Judge Perry said he will allow the jurors to know that Smith was in rehab but not watch the interview.

Stern’s shining star!!!
Thanks QV and those who helped gather all this info. I appreciate having it together for reference as the case moves to trial. (Once again, IMO there was never a plea bargain offered and there won’t be. The prosecution’s case is air tight and will go all the way to trial.) Time to put the seat belts on. I believe we are in for a nail bitting and bumpy ride for the next dew weeks folks.
I continue take issue with and am confused with what has been written in the press about Judge Perry’s comments regarding…

To me it sounds as if the party reporting from the court room is mixing apples and oranges and combined the Judges comments from various discussions. I don’t see the Judge being that ignorant of procedures and criminal matters especially with his background.
Judge Perry would be well aware that the prosecution of the doctors for over prescribing, falsifying records, etc, etc, is and must be California based since it was initiated by the findings of the California Medical Board investigation. Furthermore, the doctors are licensed and operated in California not Florida. IF Florida had prosecuted these doctor’s in the death of Anna Nicole, the California Medical Board could have used that investigation along with theirs to prosecute, take them to trial and remove their licenses here in California. Though this case will work backwards, first in California then back to Florida, the doctor’s (and Stern) will still have two trials. (Obviously, they have no intentions of pleading guilty to anything.)
It would also seem that at some point in the day long discussions Judge Perry also correctly reminded the prosecution that this case is not about Anna’s death but about the over prescribing and conspiracy to obtain drugs for Anna. He would say this to keep the prosecution’s case focused on the filed charges before them. Is it possible that in this discussion about whether the prosecution could bring up her death that he might have suggested or wondered why Florida was not handling the (death) case? Surely he would have advised the prosecution that her death is a Florida matter, for Florida to handle, and shouldn’t be brought into this case.
We will never know the whole picture because it appears to me comments are being taken out of context. The reporting thus far is cut and paste and definitely not very good. This is why I wish it had been televised. Hopefully once the trial starts some good reporters will follow the case and not just TMZ and Deutsch.

In an article from yesterday Deutsch seems to make it sound like the Judge doesn’t understand why “manslaughter” charges weren’t brought in FL. That makes more sense then her article from the other day which made it sound like the Judge wondered why the drug charges weren’t brought in FL.

“Most of the jurors have heard there was an overdose in Ms. Smith’s case,” he said. “Another case I’m aware of where a celebrity died, a doctor is charged with involuntary manslaughter in the death. You don’t have that here. ”
The reference was to the case of Dr. Conrad Murray, charged in the death of Michael Jackson.
Perry said it was clear the prosecutor would like to try the three defendants on a similar theory, but he said there is no jurisdiction for that in Los Angeles.
“I don’t know why it wasn’t tried in Florida,” the judge said.

One has to remember that Deutsch tends to have a bias in favor of the defense and her reporting tends to be somewhat inaccurate. At least here with the new article it seems to clear up this point a bit.

Thank you SheStone. That makes a lot more sense than how it was first presented. I am glad Deutsch clarified or should I say “corrected” her article. That statement just didn’t make sense in that context coming from the judge.
Personally, reading between the lines and IMO, I think it’s very telling that the Judge is curious why a manslaughter charge wasn’t brought forward in Florida. I would imagine he’s basing that statement on what he’s seen thus far in the case. Stern must have wet his pants when he heard that.
I see the jury questioning is on. The prosecution needn’t worry about bringing up Anna’s death or the Clown Video for that matter. Unless you were under a rock that first year or two you couldn’t help but have seen the news and that Clown video. Everyone knew her death was a drug overdose and actually no one was surprised it happened. Obviously, from what’s being reported so far, the responses to the questionnaire confirms that fact.
All in all, I think it’s time to read between the lines. I try not to pay attention to the fluff and story around what Deutsch writes. It’s obvious she takes things out of context and she wants to sensationalize just like TMZ does. I’m paying attention to the actual evidence produced and the statements that are made and by whom. A lot of “facts”, information and investigated scenerios, ie. email to Bonnie Stern, are being given out and that’s all that matters. It sure will be nice to find out what all is in the prosecuter’s bag (boxes) of evidence.
Removing all the information that I have garnered since her death, I’m trying to approach this case as if I was a juror who had limited knowledge of the circumstances and parties involved. Trying to get into the mind of a juror to see what they would think about what makes sense and what doesn’t. After all, their duty is to make a decision based on what they see and hear brought forward in court; not what’s on the blogs or in poorly written articles.

Its a darn shame we cant have someone writing for the AP who can make things clear and is not working from a place of the defendants point of view. SheStones example pretty much clears up what Perry was really saying.
