Larry Birkhead Pandering For Howard K Stern On Access Hollywood

February 5th is the day trial is scheduled to begin for Howard K. Stern and doctors Sandeep Kapoor and Khristine Eroshevich for felony charges related to the drug overdose death of Anna Nicole Smith. Its anyone’s guess as to whether it will go forward at that time.

But, here’s a clue! America’s favorite “pimp-daddy”, Larry Birkhead made an appearance on Access Hollywood seemingly to proclaim Stern’s innocence and throw the doctors under the bus.

Even though Birkhead acknowledges that Stern “wreaked havoc” on his life, he proclaims that he would be shocked if anything “came down” saying that Stern hurt Anna Nicole or her son Daniel Wayne Smith who both died of drug overdoses.

In contrast, pathologists testified at an inquest into Daniels death that no evidence was found proving Daniel to be a drug abuser.

Birkhead, on Stern injecting Anna Nicole: Never once did I see Howard inject Anna Nicole. I think we will hear a lot of colorful things from a lot of colorful people. I did hear that was said…about Howard injecting her.. when they get cross examined, we’ll see how they hold up.

Perhaps Birkhead didn’t see it, but at the preliminary hearing for the upcoming trial, Anna Nicole’s bodyguard Maurice Brighthaupt testified that he saw Howard K. Stern cook a crushed Valium pill in a spoon and also saw him inject her four or five times in the months leading up to her death. He also saw Eroshevich inject a substance into Anna Nicole.

About the doctors who prescribed the medicines.. “they were friends of Anna Nicole, also her doctor(s). I was witness to things regarding their interaction and I think that’s probably what might be of interest in the case and some of the other things that go along with the time line.”

Mark Speer, a highly decorated retired Los Angeles County Sheriffs Deputy swore in Howard K. Stern’s lawsuit against Rita Cosby for the book Blonde Ambition, that Birkhead gave him a needle that was used to inject Anna Nicole to hold for safe keeping. He ended up taking it back after Speer spoke to the DEA about the needle and they showed no interest.

Speer testified that the finger prints of TrimSpa owner Alex Goen might be found on the needle and vial and also that he believes that Larry Birkhead was “bought off”.

In what was believed to be a last ditch attempt on Howard K. Stern’s part to silence Speer in his suit against Cosby, Stern filed a lawsuit before Speer was to give his deposition. Stern eventually dismissed the lawsuit against Speer. In a press release, Speer said, “I am delighted that the frivolous lawsuit brought against me by Howard K. Stern has appropriately been dismissed. I stand behind all the statements I have made in this case. I am glad truth prevailed.”

Stern also dismissed his lawsuit against Rita Cosby. Stern’s criminal attorney, Steven Sadow is fond of stating to the media that “settlement” terms are confidential. However, the document ending the case states that it is dismissed in its entirety without costs going to either party. Does that sound like a “settlement”?

Birkhead said there needs to be clarification as to whether you can pick up prescriptions in a different name. He said the drugs Anna Nicole used, were prescribed by doctors and “who doesn’t trust her doctor….. that’s the unfortunate thing“… He also added the conditions she was prescribed the cornucopia of drugs for were seizures, insomnia, stress and swollen hands.

Birkhead did not volunteer to testify and said he was served a subpoena. “A lot of people think I was called to testify against Howard. I don’t like to say I am testifying for or against anyone. I just take the truth and either side can dissect that and do whatever they want and see where it fits in for them.”

Birkhead continued the media blitz tactics that he and Stern are being accused of and sued for in Harris County Texas by Virgie Arthur, Anna Nicole’s mother.

I was simply fighting for my daughter, when I went to court everyday, I was not fighting for some of the things that people around Anna Nicole were fighting for that were going on around her, whether its money or attention or whatever. I simply…when I got my daughter, I laid down my gun, if you will, and said this is what I’m going to do for my daughter… I’m going to be positive and anyone that’s positive around me, I’m going to let into Dannielynn’s life and my life. I said that on the stand a couple of years back and I still stay strong on that and Howard of all people, has actually been kinder to me than some of Anna’s own family members and he has actually helped me through a lot of things that I would not have known, whether it was estate related, or whatever. Its actually become an odd type of friendship but it is there and I tried… but that does not mean that if I have to say something that I know about… I’m not going to try to change my story…you want to get in there and prove your point and make sure your case is strong.

At the end of the interview, it was clear that Birkhead was trying to make excuses for his testimony which changed from the time of the battle over Anna Nicole’s body in 2007 until now. We will explore that more when the trial actually starts.

Pictures Don’t Lie – How Embarrassed Is Judge Chin Today?

What a news day yesterday in the Anna Nicole saga. I think we have only seen the tip of the iceberg too.

However, my thoughts keep straying to New York where Judge Denny Chin in Howard K. Stern’s lawsuit against Rita Cosby, the author of Blonde Ambition is getting ready to release previously sealed documents. When Judge Chin rendered his decision against certain areas for Summary Judgment for Cosby, he said, “One point that I find troubling is that Anna Nicole Smith would entertain herself by watching this videotape.” He also used the word “preposterous” according to the New York Post. He was referring to evidence presented that Anna Nicole entertained herself by watching a gay sex tape of Larry Birkhead and Howard K. Stern getting it on.

I have to wonder if the Judge even read the depositions and evidence presented about the type of lifestyle Anna Nicole Smith and Howard K. Stern led. I bet he will see it now because its all over the news and you can’t hardly miss it.

“NANNIES CLAIM HOWARD K INJECTED ANNA NICOLE”

…In new court docs, the special agent (from the California investigation) claims the nannies, who worked in Smith’s Bahamas home, claimed “Stern and Dr. Eroshevich would crush pills, heat them to turn them into liquid and inject Smith.”

The nannies told the agent, “after taking the pills or being injected Smith would be ‘like you were drinking,’ often falling in the house, and sleeping for two or three days at a time….” (anyone remember bodyguard Big Moe saying basically saying the same?)

Now, Larry Birkhead looks daggers at Anna Nicole in this picture below taken at a Gay Parade in 2005. But I wonder if at another event were Larry and Howard entertained standing by while Anna Nicole helped magician Steve Wyrick’s dreams come true? You can read all about that here where it says after Anna Nicole’s public demonstration, that she accompanied Wyrick back to his hotel room for more fun.

I love how Judge Chin ruled for the Bernie Madoff case, but he needs to get his reading glasses on and admit he made a mistake when he said it was “preposterous” that Anna Nicole would watch two of her self reported lovers doing the wild thang.

Hopefully Judge Chin will read the Los Angeles Times news that broke yesterday about Smith and Dr. Eroshevich having sexual relations in a bath tub. I wonder who the photographer was?

…The investigation also turned up images that authorities contend are evidence of a lack of professionalism by the doctors.

Three photos on the hard drive of Smith’s laptop show the model and Eroshevich naked and embracing in a bathtub, according to an affidavit. The photos are dated two months before Smith’s death.

Another affidavit cites video, previously aired on Inside Edition, showing Smith in a “nightclub setting” with a shirtless Kapoor who “was kissing and nuzzling” her. Kapoor’s attorney said the video was taken after a fundraiser for a charity and was the only time the two ever socialized.

An attorney for Eroshevich declined to comment on the nude photos but said the doctor’s commitment to helping Smith in her time of need was at the heart of her actions.

She “was in a position of either doing nothing and leaving a psychologically unstable person to fend for herself or attempt to help Anna even if the circumstances surrounding the treatment were less than ideal,” said lawyer Adam Braun….

Regarding the lawsuit of Howard K. Stern vs Rita Cosby, there is current debate regarding the truth or falsity of the allegations in Cosby’s book, Blonde Ambition. This happened after New York Southern District Judge Denny Chin denied part of Cosby’s motion for summary judgment. Her publisher, Hatchette Books won their motion for summary judgment and was released from the lawsuit.

Part of the lawsuit will hinge upon statements that may have been made by two Haitian nannies who worked for the late Anna Nicole Smith. I noticed the discussion about Lincoln Bain aka Mr. Controversy who had appointed himself spokesperson for the two nannies on a Topix board.

So on September 1st, I went into the Internet Archives and copied and screen shot a few things that would show statements actually proving that there were sources who said the late Anna Nicole Smith’s nannies did indeed make claims of Anna Nicole watching a gay sex movie purportedly starring Howard K. Stern and Larry Birkhead. Not only that, but Bain did post what he called censored and uncensored “Nanny videos”. It appears the uncensored versions were on his website for awhile. He then edited them but promised to again publish the uncensored versions at a later time. That never happened. The screen shots and copy and paste items below tell the story.

While I was working on this article I noticed some odd things happening so I went into the log files of this site. I found that someone had hacked in. I found they were on the site the day before. It appears that whoever hacked into this site had an interest in the Art Harris article posted right before this one. The did a search on my site. The search was done on the article, “Mr Art Harris, A Modern Day Lord Haw Haw. The search words were, Art+Harris+compares+himself+to+Don+Clark.

This site has been intruded upon before but it was spammers dropping their links into the site files and when I got to the bottom of what was going on, I did not pursue the hackers. This one is different. The hacker obviously has an interest in Art Harris and my article that was great enough to cause them to hack my website and start trying to tamper with this article while I was working on it. So hacker person, if you are reading this, I am not going to let this go until I find out who you are and you are criminally punished for breaking the law.

Now we have a mystery. Why did a hacker who was interested in an article about Art Harris tamper with an article that had yet to be posted about Lincoln Bain?

On to Lincoln Bain….These are either screen shots from Mr. Controversy’s archives or copy and pastes that I do have screen shots of but were too large to place on this page. With the Cosby lawsuit previously protected documents/depositions about to come out, I thought it would be fun to go on a stroll down memory lane. Unfortunately, a lot of pages were without dates. Thanks to Controversy TV exclusive interview with the former nannies of Anna Nicole Smith, Shane Gibson has been cleared of the fictitious accusations of the Affidavit posted on TMZ.com. The nannies, in particular Quethlie Alexis whose name was on the fake affidavit refuted the following thus far:

An explosive tell-all book about Anna Nicole Smith’s sad demise alleges the two men who battled for custody of her baby girl and control of her fortune were gay lovers.

The bombshell allegations about the steamy relationship between the former Playboy Playmate’s longtime companion Howard K. Stern and her baby’s biological father, Larry Birkhead, come to light in “Blonde Ambition: The Untold Story Behind Anna Nicole Smith’s Death.”

Sordid passages in the soon-to-be released book by former MSNBC journalist Rita Cosby describe how Anna Nicole and her friend allegedly caught Stern and Birkhead with their shirts off and their pants around their ankles in a Los Angeles home.

Jackie Hatten, described in the book as one of Anna Nicole’s closest friends, said the men were engaged in oral sex.

“Their bodies were intermingled,” Hatten says, according to a copy of the book obtained by the Daily News. “It was obvious what was happening.”

The shocking book accuses Birkhead and Stern of cutting a secret deal after Anna Nicole was buried in March, with Birkhead getting custody of Dannielynn in return for Stern being named executor of the star’s estate.

Dannielynn, who turns 1 on Friday, could inherit hundreds of millions of dollars from the estate of Smith’s late husband, oil tycoon Howard Marshall.

Birkhead and a lawyer for Stern both vehemently denied the accusations in Cosby’s book yesterday – and vowed to drag her into court, setting the stage for an ugly legal battle.

“None of it is true,” Birkhead told The News. “I’m gonna sue Rita Cosby for it.”

Birkhead said he was disgusted by Cosby’s claim that he and Stern were gay lovers.

“If she printed that then she is really getting sued,” Birkhead yelled. “My attorneys are going after her and that is absolutely false. And I am sure Howard and the estate and everyone else involved is going to sue her too. This is just nonsense.”

Stern’s lawyer, Lin Wood, called the book’s content “false and defamatory.” Wood said Cosby “has taken the coverage to a disgusting new low for which she will be held legally accountable.”

OK! magazine already has severed ties with Birkhead over the Cosby allegations, axing coverage of Dannielynn’s first birthday as the final part of a $1.7 million access deal.

The 244-page book reads like a whodunit novel with cliffhanger chapters, plot twists and tales of deception by those closest to Anna Nicole.

The former stripper knew both Birkhead and Stern were gay, the book alleges. But Smith, who was obsessed with Marilyn Monroe, chose Birkhead as her lover because she wanted a blond, blue-eyed baby, according to Cosby.

The tell-all claims Anna Nicole would spread out on her bed and watch a video allegedly showing Birkhead and Stern having oral sex “over and over” while Stern worked on his computer in their Bahamas home. The existence of the video was confirmed by a source yesterday.

Stern is portrayed in Cosby’s book as a jealous, money-grabbing control freak who manipulates the erratic blond beauty’s celebrity status for his own financial gain.

As her life spun out of control after the death of her son, Daniel, last September, Stern kept Anna Nicole hidden from friends and forced the heavily drugged model to sign stacks of paperwork, the book claims.

His alleged “goodie bag” of meds – including Vicodin, Valium, morphine and Demerol – were never far from reach.

“He was the pharmacist and [the bag] was the drugstore,” Anna Nicole’s ex-boyfriend Ben Thompson told Cosby.

In Anna Nicole’s final days, the buxom blond was holed up in Room 607 at the Hard Rock Hotel in Florida, with a raging 105-degree fever, the book says.

She was watched by Stern, her bodyguard, her psychiatrist and a handful of aides as a pus-filled abscess from a needle injection in her left buttock caused an infection in her bloodstream, Cosby writes.

Cosby alleges a right-handed Anna Nicole could never have administered these injections herself.

As Anna Nicole’s life slowly ebbed away, Stern allegedly abandoned her to keep an appointment with a boat broker. The book describes him as cold and nonchalant when told of Anna Nicole’s death – a far cry from the picture of a doting lover he painted in interviews.

As doctors rushed Anna Nicole to a hospital in a futile bid to save her life, Stern allegedly was already on the phone to media contacts lining up lucrative exclusive interviews.

“Howard was ready to make his next deal,” an eyewitness says in the book. “It showed us that to Howard it was all about money.”

Birkhead comes across as no angel either. The book claims Birkhead gave Smith cocktails of drugs and watched as Stern allegedly gave medication to Anna Nicole while she was attached to an IV drip in the hospital during her pregnancy.

His image as the “aw shucks nice guy” was a carefully crafted ploy to manipulate the media, Birkhead’s former lawyer Debra Opri told Cosby. Opri is suing Birkhead for failing to pay her legal fees.

Yesterday, Birkhead dismissed Cosby, whose MSNBC show was canceled last year, as a has-been TV hack.

“She got fired and nobody wanted her,” Birkhead told The News. “The last story she did was on Anna and now she is doing this book because no one will hire her.”

Stern’s lawyer was equally outraged, saying: “It appears that Ms. Cosby has joined the ranks of tabloid journalists who are willing to publish the print equivalent of sewerage to engage in character assassination for profit.”

And then it all changed. This October 2007 article appeared on Bain’s web site. Bain set up a sting operation to try to entrap Rita Cosby when she wanted sworn statements from Anna Nicole’s nannies. The rest is history…..

Lawyer sues Rita Cosby, publisher over allegations of affair with Birkhead

ATLANTA – Anna Nicole Smith’s lawyer and companion, Howard K. Stern, filed a $60 million libel lawsuit Tuesday against Rita Cosby and her publisher over a book she wrote that claims Stern and Smith’s ex-boyfriend, Larry Birkhead, had a sexual encounter. blah blah blah

Speaking of Art Harris. The previous article highlights how Harris tried to deceive the appointed computer expert in Virgie Arthur’s conspiracy and defamation lawsuit against him (and others including Howard K. Stern). Harris has said that Stern shares his deepest secrets with him. Now since the deception has been discovered, Harris wants to un-appoint the renowned attorney and forensics expert Craig Ball. Harris’s proffered computer hard drive had been switched out and he omitted twelve other items he was ordered to turn in. His attorneys have now filed a “writ of mandamus” and asked for a stay in examining Harris’s media.

Stern vs Cosby Will Go To Trial – Hachette Books Win Summary Judgment

The Honorable Judge Denny Chin of New York’s Southern District Federal Court rendered his decision yesterday in the case of Howard K. Stern vs Rita Cosby and Hachette Books, on Cosby and Hachette’s motions for Summary Judgment.

Hachette Books won their motion and are dismissed from the case. Judge Chin found that a book publisher has no obligation to investigate a book author’s sources.

Cosby’s motion was granted in part and denied in part.

The dismissal of Hachette naturally has the affect of reducing any award that Stern may reap if this case, barring settlement goes to trial if by chance he would win any of the remaining counts he cites as defamatory.

Stern said Cosby attributed the following to him in his original complaint about her book.

Judge Chin makes note that as the non-moving party, the court construes all facts in a light most favorable to Stern.

Cosby’s motion for summary judgment was granted as to Statements 3, 4, 5, 6, 9, 10, 12 and 14. Summary Judgment was denied as to Statements 1, 2, 7, 8, 11, 13, 15, 16, 17, 18 and 19. The later are the issues that will be before a jury if this case goes to trial.

Thinking of how close any of us who follow the Anna Nicole cases could have came to having a copy of one “smoking gun”, which became counts One and Two is regretful. Mine personally is that I did not save the video displayed on former Bahamian resident Lincoln Bain aka Mr. Controversy’s site. Nor had anyone else who I asked.

The video was replaced with a disclaimer that it had been edited. Although Bain assured his readers the full and unedited interviews with Anna Nicole’s nannies, Quethlie Alexis and Nadine Alexie would be placed back on his website, it never happened.

Lincoln Bain, who previously voiced his opinion that Howard K. Stern is homosexual ended up becoming a spokesman for the two women and was instrumental in foiling any attempts that Rita Cosby made to get sworn affidavits from them. Bain then mysteriously became a “so called” reporter for journalist Art Harris. Harris has written on his blog that Howard K. Stern shared his innermost secrets with him, leaving inquiring minds to wonder what happened to cause Bain’s change of heart regarding his criticism of Howard K. Stern.

I can say that because I was fortunate enough to speak to a couple of different sources who attended the inquest into the death of Daniel Smith. Bain’s reporting on Harris’s site about the inquest greatly differed from what I was told. Read the series here, here and here and here and here and here.

Shortly after the conclusion of the inquest and 15 minutes of fame on Fox News where Bain did a 180* about the two nannies from his original reporting, Bain closed his website down and has claimed to have left the Bahamas to move to the UK. The two nannies also disappeared and have not been heard from.

Judge Chin’s 58 page opinion says that a jury should hear what encompasses the questions of whether Cosby was reckless and acted with malice in publishing certain portions of the book or was wrong to rely on certain sources who told her that:

Stern and Larry Birkhead are homosexual and Anna Nicole frequently watched a video of Stern and Birkhead engaging in gay sex.
Stern acted as a pimp and collected money from numerous men in exchange for sex with Anna Nicole.
Stern lied about being the father of Dannielynn.
Stern is responsible for the deaths of Anna Nicole and her son Daniel Wayne Smith.
Stern embezzled money from Anna Nicole and sent it to offshore bank accounts.
Stern had Anna Nicole’s will faxed to him five days before her death..

Judge Chin dismissed the following counts and said that Cosby was not reckless or acting with malice and a jury will not hear when she wrote:

Stern and Anna Nicole were users of cocaine.
…in regard to the conviction of Mark Hatten for assault and stalking Anna Nicole. Also that Stern tried to get Hatten to murder Pierce Marshall who was fighting a multiple year battle over her late wealthy husbands millions.
That Stern perjured himself on the stand in the February 2007 Florida burial hearing when he falsely denied being paid for an interview by Entertainment Tonight.
Stern destroyed evidence by flushing pills down the toilet he reportedly found in Daniel Smith’s pocket after he mysteriously died.
Stern offered Birkhead custody of Dannielynn and other enticements in return for Birkhead leaving him as executor of Anna Nicole’s estate.
That Daniel Smith told “someone” Stern kept feeding his mother drugs and that he controlled Anna Nicole like a “Svengali”.

While Stern is busy defending himself in Los Angles Superior court along with two of Anna Nicole Smith’s doctors, Sandeep Kapoor and Khristine Eroshevich, for felony drug charges in connection with the drug overdose death of Anna Nicole Smith, he will also continue to litigate this case with the next hearing being a pre-trial conference in Chin’s court on September 11th at 12:00 pm.

Scared Monkeys Pathologists and Lawsuit Updates

Tomorrow, March 20th 2009, there are a few things happening in the ongoing lawsuits that Howard K. Stern is involved in.

In Los Angeles, where I can not get documents from by the way, there is a hearing in Howard K. Stern vs Mark Speer. Speer was a body guard who helped Larry Birkhead, father of Anna Nicole Smith’s daughter Dannielynn, with security. Stern is accusing Speer of libeling him by statements that appeared in Rita Cosby’s book Blond Ambition. Stern is suing Cosby for the book as well.

Attorneys for Stern filed the lawsuit against Speer and Jackie Hatten who was a friend of Anna Nicole Smith’s, the night before Speer was to give a deposition in Stern vs Rita Cosby.

I believe the hearing tomorrow concerns Speer asking for the case to be dismissed under Anti-Slapp laws.

Speer is employed by a private military and protective security company Jax Desmond Worldwide. They released a statement after Howard K. Stern was arrested for felony drug charges related to the death of Anna Nicole Smith. Jax Desmond is offering physical protection at “cost” to anyone associated to cases involving Stern. Services will be decided on a case by case basis.

Also tomorrow, in Houston Texas, the State lawsuit of Arthur vs Stern et al has a hearing scheduled. Although Neil McCabe, attorney for Virgie Arthur filed a motion to cancel the hearing due to a bankruptcy filing by one of the defendants and attorneys for another defendant, Art Harris filed a motion for continuance, neither motion was addressed by the court. According to a clerk in the 280th district court in Harris County, the hearing will go forward.

Another defendant, Bonnie Stern the one who filed bankruptcy is not required to appear because of that filing but attorneys for Howard K. Stern and Harris are expected to be present.

McCabe says the issue tomorrow will be “personal jurisdiction in Texas over non-resident defendants who have filed special appearances to contest jurisdiction”. He said that even though Stern lost a jurisdictional battle in a now dismissed related Texas Federal case, that ruling will not control in the present case, which involve different allegations.

The thing that struck me about that interview which featured Pathologist Dr Cyril Wecht, Author Dawna Kaufman and Former FBI Special Agent Don Clark, was Dr. Wecht’s demeanor which was remarkably similarity to Dr Perpers on last Saturdays Geraldo show.

Both men are coroners/pathologists. Both men are accused in the court of public opinion of botching autopsy’s. Perper on Anna Nicole Smith because he relied on someone for important information who had a personal interest in the finding of “accidental death”. That person, Dr. Khristine Eroshevich has now been indicted for felony drug charges related to Anna Nicole’s death.

Wecht who did Daniel Smith’s autopsy and charged over $40,000 for it repeatedly gushes in the press that Daniel (a non abuser) died from a lethal “cocktail” of drugs. In fact, Daniel died from a suspicious massive overdose of methadone which was not prescribed to him. To date, no one has been able to adequately explain how or where Daniel could have came upon this drug.

Both Wecht and Perper have reputations at stake here (ah hem..where have we heard that before). Wecht who had been previously indicted on almost 100 felony counts of public corruption charges, later reduced to 14 emitted an eerie high pitched screaming sound just like Perper did on Geraldo as he defended his autopsy findings, defended Stern and also bashed and trashed Anna Nicoles mother Virgie Arthur. Amazing, since Wecht as a so called professional, has no personal knowledge of Mrs. Arthur and admitting his information came from “what he has read”. With all the trouble he is in, that is one person who has a lot of nerve mouthing off…

Anna Nicole Smith- Gone Two Years But Never Forgotten

The second anniversary of the death of Anna Nicole Smith is upon us. She died two years ago today on February 8^th, 2007. I was a fan of her reality show and watched her personal appearances. I saw radio shock jock Howard Stern berate her for weight gain and I celebrated with her when she debuted slim and triumphant as the spokeswoman for Trimspa. She then ended up having the second child she always wanted only to have her beloved son Daniel die three short days after the birth of baby girl Dannielynn Hope. Five months later Anna Nicole Smith was also gone.

That’s why I started this website. It was called “A Mothers Last Wishes”. I already told the story of this blog and the blog war that ensued in this series of articles. A year has passed but what I said then is what I would say now if I were to write that part all over again.

The deaths of Anna Nicole and her son Daniel have spawned not one but several civil legal actions. First there was an inquest into Daniels death. Many were thinking that criminal charges could have been pressed in the Bahamas against Anna’s attorney and friend Howard K. Stern for Daniels death. The jury, who were instructed to come back with a specific verdict in that country known for corruption found Daniels cause of death to be non-dependent drug use.

Stern has been a busy man though. He has sued TV journalist and book author Rita Cosby for her book, Blonde Ambition. Ms. Cosby’s book outlined the suspicious circumstances of Anna Nicole and Daniels deaths. That suit is still ongoing in the United States Southern District Court of New York .

Stern sued Houston Texas billionaire attorney John O’Quinn. O’Quinn represented Anna’s mother Virgie Arthur in Florida Broward County Court as she fought for the right to take her daughters remains back home to Texas. But Daniel was buried in the Bahamas. Early reports from the funeral home handling arrangements indicated that Daniel’s body was being prepared for shipment back to the United States. It’s rumored that Anna Nicole was told she could not afford to do this. This was even after photos were sold for several hundred thousand dollars of Daniels last hours with his mother and sister. Anna’s remains went back to the Bahamas with Daniels and there they rest alone. Stern’s defamation lawsuit against O’Quinn he says, arose from statements that O’Quinn made to the press during and after those hearings.

Stern vs O’Quinn has settled. There was no statement from either party but speculation continues because there was a continuance granted to the defense on the date set for settlement talks. To the surprise of followers of the case, settlement talks proceeded anyway.

Stern as executor of Anna Nicole’s estate sued G. Ben Thompson and Ford Shelley who were former friends of Anna Nicole. They sold her a house in the Bahamas which they were never paid for. When Anna Nicole died, Ford Shelley entered the home and took things belonging to Anna Nicole. Shelley said she told him to do that in case anything ever happened to her. Which it did. What has been revealed has sparked worldwide controversy as to how much responsibility Stern should share regarding the deaths of Anna Nicole and Daniel.

Via Ford Shelley and Geraldo, Americans were treated to the infamous “Clown Video” where Anna Nicole is eight months pregnant and apparently under the influence… Just about every instance of that video has been removed from the internet even though Stern says the video was supposedly a joke that Anna Nicole planned to publish on her website. From a still publicly unknown source, pictures circulated the internet of Anna Nicole purple, hysterical, weeping and devastated while she held her dead 20 year old son Daniel in her arms in the Bahamian hospital where she just gave birth to her beautiful daughter.

In the meantime, Anna Nicole’s mother, Virgie Arthur, sued Howard K. Stern, CBS Studios and KRPC Houston for the Entertainment Tonight segment that will forever be called “The Mommy Dearest” video. It’s actually what brought me to this story. The sight of Anna Nicole weeping and seething in anger at her mother, whom I had never read or seen anything about was heartbreaking. It was that show which prompted me to start this blog. Only to later find out that Anna Nicole was deeply impaired during the taping of the show. According to those close to her (including baby daddy Larry Birkhead), she was being kept drugged and out of it and told things that were just not true. Although Birkhead has changed his tune these days and is said to be a very close friend to Stern.

Mrs. Arthur’s lawsuit started in Texas State Court and was then removed to Federal District Court . Neil McCabe, Arthur’s lead attorney petitioned the court to add other parties to the case. The court denied the request but declared any case against the proposed added defendants “cognizant”.

That brings us to Virgie Arthur’s Houston Texas case for defamation. Mrs. Arthur through the O’Quinn Law Firm is suing Howard K. Stern and his sister Bonnie Stern. TMZ.com, Harvey Levin, its managing editor, Art Harris who is a special correspondent for CNN and other programs and networks, one blog owner, Nelda (Rose) Turner and two of her moderators who are Teresa Stephens and Lyndal Harrington.

Defendant Rose Turner of rosespeaks.com has an “entertainment blog”. She says she likes to cover various high profile legal cases. Rose wrote almost exclusively about the Anna Nicole Smith debacle until she was served with the current defamation suit. Now she covers other issues as well.

After attorney William Ogden who was representing four of the defendants in that case decided that he could not afford to continue defending at least two pro bono defendants, Rose and Lyndal Harrington, (per Turner) he resigned from the case also leaving those two and two other clients, Bonnie Stern and Art Harris without representation.

Rose, finding herself without an attorney was faced with having to either cooperate with Neil McCabe’s requests for discovery or the judge in the case, The Honorable Tony Lindsay was going to issue an order compelling Turner to surrender her computer to forensic expert Craig Ball who has been appointed for this case. Turner decided to cooperate with McCabe rather than turn over her computer. The other defendants have been ordered to turn their computers and emails over to the forensic expert due to possible spoliation meaning possible destruction of evidence.

Turner had in her possession an email from Bonnie Stern that was enough for attorney Neil McCabe to bring one more party into this lawsuit which not only charges defamation but conspiracy to defame Mrs. Virgie Arthur. That party is the father of Anna Nicole’s baby daughter Dannielynn. In the court documents, McCabe charges it was Larry Birkhead who gave a mean spirited story TMZ published that implied that Mrs. Arthur married her step-brother with Howard K. Stern “sourcing” that story. In reality, Mrs. Arthur did not marry nor have a child with her step-brother. Their respective parents married later on. Millions of readers saw that story and voted on a poll all designed to humiliate Mrs Arthur.

And then another twist to the story. Defendant Nelda Turner last week, filed a motion to bring CBS into the State case. The Federal case against Stern and CBS had been dropped with costs being attributed to each party. Onlookers suspected a defamation case against CBS was not over but no one ever thought it would be Turner who brought them back in by way of the existing state case. Turner then announced that one of the defendants, Bonnie Stern has filed for bankruptcy. Research shows that this action will stay the Texas State case however there are legal remedies that I am assuming will be discussed in future hearings that may allow the case to continue while Bonnie Stern follows through with her bankruptcy petition.

The suit against Cosby continues. On the eve before former Los Angeles police officer and former body guard of Larry Birkhead, Mark Spear was to give a deposition in the Cosby case, Howard K. Stern filed a lawsuit against Spear and Jackie Hatten who was a personal friend of Anna Nicole’s. Stern claims both parties libeled him and caused false information to be published in Crosby ’s Blonde Ambition.

Sterns suit against Thompson and Shelley continues as does Anna Nicole’s lawsuit against the estate of J. Howard Marshall which she took all the way to the Supreme Court of the United States and prevailed in allowing it to be heard. Anna Nicole’s surviving child Dannielynn would be the beneficiary of anything won in that action but also big legal fees would go to Howard K. Stern.

Larry Birkhead with daughter Dannielynn appeared as a surprise guest on Larry King Live the other night which was featuring “the crying judge” from the Anna Nicole burial hearing, Larry Seidlin. Birkhead and Stern are spotlighted in a television special that is airing on “E!” television called, “Anna Nicole, Tragedy in Paradise”.

Birkhead said he and Dannielynn are set to star in their own television reality show on the same network which just happend to be the network which created Anna Nicoles reality show back in 2002. It appears on all fronts that Birkhead is the new Anna Nicole Smith. He does not say who his manager is but for all intensive purposes, he has her possessions, her child and now he wants her stardom.

An investigation into the prescribing practices of one Los Angeles doctor and the psychiatrist who prescribed eleven medications of which eight were prescribed in Howard K. Sterns name was announced by California Attorney General Jerry Brown in October of 2007. Dr Kristine Erosovitch and Dr. Sandeep Kapoor had their offices and storage units raided by the California AG.

The much anticipated investigation continues and another bomb shell was dropped just days ago.The offices of Dr. Sandeep Kapoor were raided again and this time TMZ is reporting that United States Drug Enforcement Administration assisted in serving a search warrant along with the California Medical Board. They are looking for a connection between the doctor and Howard K. Stern.

As for me, I have been named as a cooperating witness but former co-conspirator in Virgie Arthur’s defamation lawsuit in Houston Texas. It is said that evidence I and one of my former moderators, “Havana“, submitted to the O’Quinn firm has made this state case possible. We being tiny links to a larger chain of conspiracy.

My opinion of the sad deaths of Anna Nicole and Daniel has changed drastically. However as a witness, I find it best to keep my thoughts to myself. I have been maligned and attacked by Turner and the members of her website on the internet. I refuse to engage. The truth and substance of this case will be sorted out in a court of law. I stand by all I have said and will quietly remain until the final gavel falls.

There are many who desire to know the whole true story behind the lives and suspicious deaths of Anna Nicole and her son Daniel. Her adorable daughter Dannielynn deserves to know.

Hopefully with the latest raid in California and the ongoing investigation, the world will get some answers as to why two people had to die too young and too soon.

Now that Howard K Sterns defamation lawsuit against Houston attorney John O’Quinn is tentatively settled, it appears the wheels will start turning in Virgie Arthur’s defamation lawsuit against Howard K. Stern and CBS Studios in the Southern District Court in Houston Texas.

There has been a protective order issued by Judge Lee H Rosenthal in the case, just as there has been in all the other cases that have arisen out of the tragic death of Anna Nicole Smith and her son Daniel.

One of the sections of the order says “confidential information shall not be used for purposes other than in connection with this case”. However, we saw Rita Cosby in New York who is also being sued by Howard K. Stern, freely hand over her deposition as well as those of investigators Don Clark and Wilma Vice to the Florida case.

Howard K. Stern was the only person who objected to having his deposition used from the Cosby case and he is the Plaintiff in both cases. Not too long after, the Florida case is tentatively settled. Could the same happen here?
