Guest_1483 : It would benefit Arthur in that they can file an appeal of the Summary Judgment now instead of having to wait until the entire case with the rest of the defendants is over. JMO
QV : Ok. I see what you meant now. On the rest, I was just hypothesizing wondering what benefit it would be to Arthur to join CBS motion?

Guest_1483 : What I meant in regards to the severance is that CBS may be worried that after the case has already been judged by a jury and a conspiracy and defamation have been found against the other defendants that the summary judgment will be overturned. Then they will end up having to litigate the case again but this time from a worse starting position. So they want to go through the appeal now. JMO
Guest_1483 : I hope you are right about the default judgments. That would be wonderful. I think you may be correct about AH, we will have to wait and see in regards to HKS. JMO
QV : I smell two more default judgments coming. Howie and Bald Wonder is my guess.

QV : Do you mean that they could be thinking evidence handed over in the future may incriminate themselves so they want to sever now? Is that your thoughts? They do mention that even if they are severed, it can be appealed. I guess it will depend upon their evidence.

Hmmm. Otherwise I don't know why they would want to sever at this junction. JMO

Guest_1483 : Yes, I agree that I wish the Appeals Court would make a decision. They have had HKS's Writ since May 18, 2009. 10 months. This is part of what is wrong with the system. It takes too long for Courts to make a decision. JMO

Guest_1483 : I don't think the Appeals Court time problems are entirely Teresa's fault. Although litigants like her and HKS do gum up the works. JMO

QV : Right..the second one is probably not. They have the deluxe edition though that holds more data. I think its $20 a year for that one.
Guest_1483 : Appeals Courts seem to have their own idea of time. The system seriously needs to be speeded up.

QV : I don't think it will be either. However, maybe the rules are different for a business account. Maybe the data is kept longer. I have no idea though. Just IMO.

Guest_1483 : Yes. It appears they will get some of the information, provided it can still be retrieved by Yahoo. If it was deleted too long ago, I don't know if it will be retrievable. JMO
